we'll do minutes and updates and stuff

Uh, so we're here this evening to talk
about a couple adjustments that we
wanted to make to the lots. Um, as you
remember, we went through uh a lot of
the information on, you know, the all
the roadways. We got all the the AOT
permits. We have the drive driveway
permits, wetland permits. Uh I think one
of them are both of them actually built.
Yeah.

built. Which one? The one next to the
fire pond

the fire pond's built.

that we're dealing with are right here.
There's a couple extra lots down over
here where the roadway is already built.
Uh what we're proposing to do, you can
see we did a little color code thing for
tonight on your handouts. So the red
line is the old lot line and green is
what we're adjusting. So these four lots
are very straightforward. I mean, it's
just barely barely adjusting the line
just to kind of get even out the
acreages, give it give it it what we
were thinking we needed for those. And
then this one is the one that changes a
little bit more. Um, we're taking a
little bit more land away from the the
large lot that's just way oversized, but
we're removing the lot line here and
having this lot go all the way like
basically a long a long lot. And then
this one has the remaining acreage that
that was left over after we did that.
um the roadway, the driveways, the
driveway, the detention pond, like all
the engineering, all the AOT permits,
like everything we had, the number of
the number of units, like everything
stays the same as what it was when we
when we had our original meetings with
you. Uh so, engine, we got we got the
review letter uh I think Monday, Monday.
That was the first time I saw it anyway.
But there was uh he was going into some
of the stuff on the engineering and
double check to like just make sure that
it all is okay that nothing changed and
it and it doesn't. Um
that's why we did the color coded thing.
So you can see that nothing nothing in
these areas that uh we're adjusting are
really going to affect the easements.
The easements kind of stay the same. The
lots all kind of stay the same except
for this one gets a decent amount
bigger.
So, I'll give some context why we're
requesting this change because it seems
really silly and don't know why.
>> Um, so the town seems like they've been
pro let's get some more rentals in town
has been the
>> the mindset of the board.
>> Tax laws have changed where they brought
bonus depreciation back for people that
are building rentals. and your zoning
ordinances call out 30,000 square feet
per unit when you're to build rental
type scenarios. So a 2acre lot you can
fit like 2.89 units or something like
that.
>> But if you go 2.1 acres all of a sudden
a three unit would be allowed acreage on
that. So to because without that context
it seems really silly why you're moving
a line 20 or 30 feet. Um, but we wanted
to have and we're not saying we're for
sure doing that. We just want the option
to be able to potentially pursue that.
And when they're two units on a lot, the
the numbers don't make sense from a
build and rent um scenario. But when
there's three units on a lot, they do
make sense in a a build and rent
scenario. So, that's a little context
between the [clears throat] lines moving
20 or 30 feet. I know it seems really
silly without that context. So,
>> but that that little extra that that's
all it took. That's all it would take is
just that little extra on these two lots
and these two lots would would be big
enough. And the ones in the back were
already definitely big enough. So,
taking away just a little bit doesn't
affect them. And this lot was huge. So,
we actually just made it go all the way
right down the easement line. So, it
doesn't really take away anything
buildable on that lot. So we just that's
that's the reason for the lines in the
way. What would six acres actually do?
Like possibility for multi-unit like
>> Um well it be I can do the math real
quick.
>> But that was the idea of making it six
is that it's potentially
>> 30.
>> So technically that would be enough for
8.7 units in your current math of 30,000
square ft per unit.
>> But that's not automatic.

think Multif family requires a ZBA

>> and a site plan review. Yeah.
>> But step one would be making sure the
lot was big enough to to do that because
obviously if you're coming to propose a
threeunit and it only meets 2.8 on your
your map, then you're already out. So

potentially happening.

everything. They own all those lots.
like somebody hasn't built a house on
the back lot yet. So that

there's
>> Yeah, just to clarify, Ella Drive, the
four lots on Ella Drive, they're not
even shown on this map because those
stay exactly the same. The plan is two
of those are built and sold. The other
two will get built and sold. So nothing
changes with those. We're only kind of
addressing the Baylor Drive.

My question is
if there were to be a site plan of view
and they say we're going to put eight
lots on this one location here,

if they were to do a peace meal instead
of saying, "Okay, we want to do eight
and three and three and whatever else we
want to do." Um,
does that give us enough information to
to review that? Meaning, um, you know,
like there's these lots behind like if
those turn into threes and those turn
into like does that affect the units on
the driver? Like I don't know, maybe
it's all still compliant, but I'm just
saying if it's done peace meal, does it
make it hard for us to actually review?
you know, this is this is it's an
interesting dialogue um that
>> I'm not sure that there's a perfect
answer, right?
>> So, we process we've seen people do a
subdivision and then subdivide another
chunk after, right? And so sequencing is
always kind of an issue. It feels funny
to be coming back like it's maybe it's
been two years technically, right?
>> So, it's been a while. It feels like
yesterday.
>> It does, doesn't it?
So, um, you know, I think one of the
questions that got raised was, is this
truly a lot line adjustment? And it
definitely wasn't an easy one to read.
So, I'm really glad we did have a review
because it was I mean, I looked at this
for a while saying, "What the heck were
you trying to do?" That's why we printed
the color code so you can see exactly

green ones are the new ones so that it's
like super
>> transparent for everybody to see what's
>> because we I know we've had that issue
before where it's like is this creating
a new lot sort of deal. Well, and and
and the other thing is that we
this is a subdivision, but I don't
believe any of the the only the people
who share a driveway have any kind of a
link to each other. Right? So, if this
was a subdivision with an HOA,
then everything you could once you start
selling, if it's one phase, once you
start selling, you can't change. If it's
single resident, then it's single
resident, right? If there's two phases,
there's some thought in the state that
you can when you go into phase two, you
can change things, but what you sold to
people, you have to give them, right?
So, if you promise 12 homeowners
>> the same thing, you can't change six in.
>> Mhm.
>> Okay. But this isn't that case. It's
it's all independent. each each of these
at most you could say each of these
roads would be um they would be getting
into remember we had the discussion
about if you have a shared driveway and
you have three homes on each of them now
you've got 12 people feeding onto a
driveway
regulation is not necessarily clear
>> right but they're they're doing it by
shared driveway so again I'm not so sure
that it's all that bad right
>> the way we stumbled upon this was we
kind of when that bonus depreciation
came out We looked at the town's
regulations of well you're allowed a
single family with two ADUs. So we
started exploring well we ran the
numbers on that and we're like wow the
numbers actually work but then the
primary unit needs to be the owner. So
we're like well that doesn't work. So
then we're like, well, what's the multif
family regulations? Because we know
three units can make sense in a new
build scenario. And that's where we kind
of stumbled across the 30,000 square ft
per unit. And we're like, okay, well, we
missed the third unit by literally that
much. [laughter] So
>> because we weren't thinking about that
at the time,
>> and that wasn't that wasn't the thought
process. Without the bonus depreciation
that passed, there's no way to possibly
build these and have them make sense.
But
>> laws change and laws, you know, that
makes it more pro building and rent. So,
here we are.
>> So, but my question though is
we tell people that they can come in
with an amended
plan uh for their subdivision
application. Mhm.
>> What are we doing? Are we amending a
subdivision or are we adjusting a lot
line?
>> So, that's one of the things that the
engineer brought up is were the
appropriate fees paid?
>> We're affecting like six of the lots or
whatever.
>> Right. So, that's a question that came
up as we go through.
>> Um I I don't think it's really what I
think if I can pose this to the board, I
would say, let's look at completeness
>> and then let's have that discussion
about fees. I don't want to blend the
two if we don't have to if

completeness first and then we can
always move into that dialogue separate
but I don't want to muddy it if we don't

this week. So, a lot of the comments
were impossible to address before

that if there's minor things that are
preventing us from kind of hearing this
tonight, we can request waivers. But
then still, if this is moving forward,
you know, conditions can be put on to
apply things that make sense. But we
feel like some of his list was a little
bit um
too thorough for the scope, but some of
his

guys go inundating us with waiverss we
may not require.

"Hey, that there's a whole lot that that
doesn't appear to be here, but let's go

application classification fees, I think
let's defer that one just for right now
until we get to the end of the other

notification list.
>> Okay. Check. Uh DATM benchmark. That one
is probably still outanding.

protective radi it was absolutely on the
plan that was shown to you before and

turned on like on the I know I know
exactly what happened with the benchmark
the benchmark was sitting right here in
front of the other lots
>> So when they did this it it just didn't
show up on this plan. So the old
benchmark is like right over here. We
can absolutely put a new benchmark on
there. and uh the well radiuses. I don't
know why they're not turned on, but they
aren't. So, very straightforward, those
two items. I did put together a waiver
letter that said for completeness only.
We'll we're definitely going to put them
on there. It's no that's absolutely
something we're going to it should be
there and we'll have that.

and very easy and I have a waiver letter
for those two just ready to go for
completeness so we can talk about the
application.
Um,
excuse me for one second.
All right. Um,
electric cable and utility easements.
Uh, please show the proposed electrical
service connection to each slot and any
utility route or easement needed
uh where the service crosses another
parcel or common driveway. So, we don't
have any engineering plans because we're
doing lot line adjustment. So, all of
that all of that stuff would show up on
the the engineering plan, which I think
I think we maybe even did have it on the
original, but the underground the
underground goes right down the driveway
and splits off to each lot as it goes.
So, the easement is in place for the
electrical and and all those easements
are already recorded. So, I think I
think we have that by virtue of the
prior subdivision being done.
>> Did you bring a copy of that?
>> I don't I don't have
>> a copy of the the old subdiv the site
plan.

completeness that we can at least talk

one that I can just instead of having to
hand write out a whole waiver request,

we can add in whatever in the middle

didn't see was the covert crossing on
um on Baylor. there wouldn't be a you
wouldn't see that on the subdivision

talk about drainage and stuff without
having that information um

merits of the subdivision to some

I I don't know that that's
really what we're doing and except for
where I mean maybe where this one lot is
being made that much larger like oh if
they go back but they can't build in
that anyway that's an easement. Um,
so
I don't know. It seems like anything
that's relating to
things that are covered by the
subdivision plan. I just I don't know
what changed.
>> So the question is what do we need to
hear to do a good job with the hearing?

without a drainage plan because there
were some significant drainage and
culverts and wetland crossings.

through tonight and not say we're at
least going to need this on the new
plans, it should just be an overlay
that's added on if they already have it
and it hasn't changed. Yeah, none of the
infrastructure that's proposed on the
original subdivision is changing. The
only thing that's changing is

right? We only have the plaque. We don't
have that. So, if you want to just
submit that same sheet again and say
this is our drainage and erosion.

my engineering plan and just have the
show the new lot lines in red on here
saying these are the lot lines and all
the infrastructure stays exactly the
same.
>> I think that's what I'm hearing
>> cuz what what you're saying otherwise
this would be the latest approved plan

with this

just be able to get another sheet that
says and this is what goes with it.

adjustment and then was there's no
drainage included here.

This is just the lines change. You look
at this, you're like, "What's up with
this subdivision?" I'm like, "Uh oh, we
have to reference back to the actual
subdivision."

on the plan that is explicit on that.

produce a new plan because uh on on the
original these four lots are no longer
part of it. So, I would produce a sheet
just like this, an overall drainage
grading. It would show the
infrastructure exactly the same way as
it as it was and approved and AOT and
like all of our things and just show
like a little lot here's where the lot
line adjustments are on this plan and
then on the sub on the lot line
adjustment that would be recorded that
SNH should prepare there'll be notes
saying the infrastructure all remains
the same infrastructure easements
crossings all that stuff remains the
same as the approval given and recorded
on XYZ Okay. But you guys will have
something in your file showing the the
all the you know the drainage pro all
the drainage and roads and grading with
the with the new lot lines on it. So you
know that this is the backup. They prove
that nothing else changed
and then there's a note on the recorded
plan that doesn't show none of that
stuff shows up on the recorded plans
anyway.

all the all other things stayed the
Um we do though if there's a chance that
there could be more earth disturbance
that's going to be

first got to go to ZBA

acres, go up the hill, which the back of

difference in drainage and storm water

slope is huge.

of your build and it requires a lot more
red tape. But

covenants
and the notes on this. I didn't notice
it two years ago, but I did notice that
the pine birch covenants for that
include the the lot that you started
with said that the the lot should not be
smaller than five acres
and they would not be further
subdividable. What's Pine Birch?
>> Pine Birch is the subdivision that
extends across Toby Highway

We had one guy come out of the B
woodwork claiming he owned some of that
land and then we had a HOA president
that was hellbent on me not building
there. So that was a very unique
scenario

today if we take case by case and we say
they paid the lot line adjustment fee
would you have been comfortable then
saying I think we need to change this if
it was a more challenging case like is
it better that we give people a heads up
ahead of time or change

much effort it is.

covered either way because you we made
the application fee and we did the third
party review. We had to pay the third
party view. So if you guys got an
application and you're like, "Oh my god,
we need a third party view." Then that
that that's the extra knowledge that you

exceedingly simple that you wouldn't

is they're all going to review unless

setbacks and frontages and all that.
And, um, it does look like we should be
able to get pretty easily three uh, ANR
lots.
With that being said,
uh we would have to get our frontage off
of um State Road 123.
And
I'm not sure if that adds another step
to the developing of it. Is that
something that we would have to go
through the state to get um a curb cuts,
you know, apply for permits that way
through them first and then through the
town? Um or is there does does that not
matter?
>> You are going to need uh state approval
to put an entryway on to 123.

>> do you know if they have a moratorum on
that or is they they just do it as as
brought to their attention?
>> Um they you will need to talk to them
about what's allowed. If I recall
correctly they're um the town on on town
roads you need 200 feet of frontage. I
believe it is more on state roads.

you're going to want to have a talk with
them about that. I don't know how many
curb cuts you would be able to get. Um
the the the where they draw the line is

again, check with them, but there is a
um there's something like a certain
number of curb cuts per parcel as of a
certain date. Um okay. And so if this
property hasn't changed hands in a long
time, um I'm a lot

say, you know what what can we do here?

You may they may say, "Hey, you have to
do a shared driveway or you may only get

with it?" Like that type of thing. So I

submitting an official application is
you wouldn't know if you have one or two
axes a access right so it would you
would your plan submission to us would
be more complete if you have an idea of
what the requirements are

more units or you might build it like

the house into a future cluster
development. you know, it's just all
kind of depending what we can get out of
it. If if you're only going to get a few
units out of it and it makes more sense
to go from 123 one curb cut come in and
get if you could get I don't know 8 10
houses or if you could do bigger
apartment complex or whatever you guys
are thinking and we can subdivide the
house out of it then you know we would
go that route. Um, but if you need the
house with it to have to be incorporated
somehow
in doing the cluster development, then
you know, we'd have to see if it, you
know, basically it's going to it's going
to make sense financially as well.

think you can logistically separate off
the house if you want to do a cluster
because you would be under 10 acres at
that point because your minimum split
off would be two acres. So then you'd be
left with eight Gotcha. So that's so
basically as soon as you subdivide the
house out of that it it now employs the
class development,

if you incorporate the home into

>> Okay. But I mean it it it gives you it
gives us thought though. We could we can
look at some routes off of that. How do
we incorporate,
you know, the house and the barn or, you

know, an entrance way off of Appleton
Road potentially now if we take that
barn out of there. Um, and probably have
enough frontage to get the 200 foot
because there's 570 ft of frontage on
Apple Road.

um, if just one lot was split off,

condos, I think, or attached or
whatever. Um, and it's 30,000 square ft
per unit.

idea, but remember when you go to a
cluster subdivision,

land to work from. So let's say you
start with 10 acres.
>> Yeah. and you put the house on 1.5 and
you have to put five into into
conservation, you now are going to be
trying to get units on three and a half
acres. So again, you start you're you're
going to be squishier than you think you
might be. Now, do you include
um you know like common common ways and
stuff like that as part of the the five
acres that has to be
>> so look at look at the the regulations.
We're not looking at them right now in
there.

you how much has to be conserved.

common land? And I think the common land
has a cap on it, but it would include
the roadways, the mailboxes, the bus
stop, um the any drainage,
the con things that everybody's going to

going to be sidewalks or what have you.
And then um and then there's the
individual lots that are that are left.
You're kind of that's what then you have
what's kind of left.

state approval no matter which way that

conventional,

and we're trying to keep it simple, I
need a state approval for that. And then
I also, if we did the cluster
development, I also need state approval

engineer could answer all those

as restricting garage doors open, the
length of grass, etc." I just changed it
to say, "We haven't seen anything as

being open,
etc."
