All right, we will start the planning
board meeting Thursday, August 13th,
2026 at 6:04.
I pledge algiance to the flag of the
United States of America to the stands.
One nation under God, indivisible, with
liberty and justice for all.
>> Roll call
chair here.
review of the July 16, 2026 meeting
minutes. Um,
I'm sure they'rebody.
>> Does anybody have any questions,
comments, concerns?
I'll make a motion.
>> All those in favor.
>> We have no hands in this month.
I actually
>> Yes.
meeting two meetings ago.
>> I think so. I just wanted to make sure
that that was
happening.
I think I signed I think I had signed
some but I was also looking at
I'll follow that when you say are you
talking specifically
don't
it's only the only two conservation
commission
or not the planning board is the most
important anybody can I know we all say
that it will be the minutes
but without taking that oath of office
it can be an issue I'll follow that but
I
call signing 812
and if you want me to go my way back I
can tell you exactly why those open
boxes are very important. So for
budget committee and those positions you
have to be not just a resident you have
to be a registered public as well.
So the select
tax collectors,
>> but yes, you need to be registered. She
must be and even if you got appointed on
the other
>> well be elected
I don't know
resilience.
>> All right. So number six, I guess we're
on um voting ordinance reviews and
updates for 2027 home prices. Um
clause.
Um
so
Blair sent us
>> words. I don't know.
this past month has gone by somewhere.
>> So,
because I'm the one that brought up
because I had a very difficult time
article 22 and understanding how it
pertains because if we go through our
zones,
>> each zone spells out what can be in
those zones. Yeah. Home Enterprises says
these people are four things.
Businesses, professional users, home
industry, home office can be in these
zones as well if they have an accessory
use.
So
I'm getting a better sense of how we
supposed to use this. There are some
confusing points. I just wondered if
anybody else has the same issue. Maybe
this is a nod to most everything along
with it, but I don't I didn't find
anything. What What was the town trying
to do? I think it was in response to
getting home offices and businesses in a
rural residential area and
obviously get out to four corn as you
can. It could be one to allow a little
bit of a balance.
>> No, it would be to allow people who
wanted to work out at home.
industries is a bit
>> scary but you can put those in
>> and then the other thing was so I'm just
not saying this is an issue
>> for all of us maybe it's just me I kind
of struggle with it too because
it's very vague and you can only
obviously like you can only list so much
stuff
um and of course the one thing that's
not going to be listed that person's
going to come forward and want to do and
that's just how it goes. And so then
you're kind of like left in the middle
trying to figure out if it's appropriate
for that area.
>> When was it written?
It was done in 2017.
The reason I asked is that was precoid
and during that during that time a lot
of people home that had never done
homework some were successful some were
not but the home business has been
transformed since then that I can work
at office
and at home and work with them to
California
>> but I think it depends on like what you
consider like a home business is like I
consider somebody like Roxan or myself I
don't consider
Home office.
>> Yeah,
>> I mean that's what I was saying
to work on except for
shall
be seen at the residence
area.
>> I think that's what everybody Right.
>> Yeah.
>> Like I think all the people that are and
they really it's like a remote worker
here. You work for a company but you
>> are doing it at your house or Starbucks
or wherever you can get Wi-Fi right now.
So which to me is also similar to well
when we go look at a home business
that looks like you're actually working
the home business
I guess I would necessarily I would
consider a home office because he didn't
work out of the house and he didn't do
business out of
Yeah.
>> It's just you know truck there and his
tools, but then they probably sitting in
his vehicle because he needs to go or
whatever. And the only like business
that he probably does is probably like
bookkeeping business like
>> part of the job. You need place to do
that.
>> He doesn't need to have he doesn't need
a rented office.
Yeah. So whereas the home business is a
trade that's conducted by the resis
and what isn't what is allowed.
>> Does it still make sense?
Well, so that's right. So, for example,
like in the Lake Village district, it's
only for like single family homes,
>> essential services.
>> Yeah, services. And so for that, it
wouldn't be allowed, but then they can
come forward to the planning board
for.
But then it says accessory uses. And if
you look at article 22A,
each of the four categories
categories
conducted as an accessory to a res to a
resial use.
What district
see
So I don't know what that means by
>> well if you go back to each stone the
pages
and seven village district. So,
>> so we actually, so we got to start back
at section eight. I basically said what
where you can have uh home enterprise.
>> Well, just those four things,
>> right? No. So, that's what I'm saying.
So,
>> yeah. So well even like for like the
basic district use so rural residential
district permitted uses single family
houses two family houses farms and
agricultural operations and then it's
like where's
>> sales products essential services backs
are allowed um accessory uses
>> right but so what does management or or
do we say in
we say in these different districts what
he's allowed and what he's allowed. So I
guess that's what we have to I think
that's a big discussion that we have to
talk about tonight is the fact that I
think
each ordinance whether it be like ADU
business whatever
when they've gotten done I think
everyone hones in and they focus on that
one ordinance but then leaves out
they forget about the rest of the
ordinance. ordinances and where verbage
falls in those areas.
>> I think a good example is campsites. We
took out the campsite ordinance and
because ours is permissive can't have
campsites since it doesn't say we can
but campsites is mentioned in two other
places. Um
>> okay to me and Noah um from
>> so
>> I guess it's a good example.
>> It is a good example. So yes, so I guess
so we would yeah so anything that we say
effective meaning we took out the canc
right
>> so is the idea to say okay here are
zoning or is that is our
we have our last stand so say we get to
this article 22 which is enterprises are
we looking to say like in in article 22
these these following
are we are we looking to say in the
ordinances
these are allowed in these districts in
these
part my response would be these are
already allowed in the middle corners in
commercial business. It's the rural
residential.
>> So I guess to clean it up. Am I Am I
right? I think I am.
>> Right. So that's what I'm saying is
should we put in here
>> call it out and say these you know some
these are allowed in these zones not
allowed in these.
>> So clear is that what you're asking Kate
>> or I I guess so in each district that we
have.
>> Yeah. So where it says like Sunrise Lake
District and then it says permitted
uses, would you put under permitted uses
all the things that are permitted like
all the ordinances? So would you put
like home enterprises if you wanted home
enterprises in the like district or you
put it in the rural residential
or like put it there because when
someone says
when I
contacted
and someone says to me
I want to open up a
salon or I want to open up a doggy day
here or anything
I always say please refer to the town
ordinances but then I also say um you
know not just review your town
ordinances but then like look at you got
to look at what district you're in so I
think if the it may be helpful for
people if when they realize it and they
say like okay what district am I in they
look at the district map and they
realize like okay I'm in the sunrise
lake village or I'm in the sunrise lake
district and then it goes out permitted
uses and if we have all the things that
are permitted
then they
sit
>> because
accessory zone these are home
enterprises apply to zones that have
conducted as an accessory use right
but
they I
home occupations I don't think anybody
who had any problem with anybody.
>> Well, and then it
starts and everything like that
businesses and traffic.
>> So, well, and it does say here for like
like district accessory uses, a
customary accessory buildings uses, um,
home occupations according to local
covenants and oral regulations. Um,
which I really hate that because
>> I love it. Well, no, but we can't
enforce it as a planning board.
>> So, actually, I thought that they put
that in there specifically so we could
so we could look at
>> we cannot according to NHMA because I
had saw that and I was like, "Wait a
minute." And I contacted NHMA and NHMA
is like, "Uh, no, you cannot."
>> So, I'm like, "Well, it's kind of
contradicting."
>> Well, then I would ask NHMA a different
question. say how can you so we can
figure it
>> you can
that is my answer you know that
>> I have I can go through and I can pull
up an email
>> I want I want to see what they said
>> but I mean it's also
>> because that wasn't in there before and
I'm assuming they added that just so you
would have to consider the compan so
circle back to conversations
What we were looking at is
home enterprises.
are we trying to I guess I'm just trying
to
>> Where are we? How do you want to move
forward on these as far as saying do we
say within here? Do we say
I don't know what you what is it that
you're having? My my first of all my
problem was I wasn't clear on
the difference between a whole
enterprise and a whole business. That
sounds ridiculous, but it's true. Well,
because they do talk about on page 60
they say a homebased business not
meeting and
not meeting anyone standard shall be
considered a home enterprise. Now that
what does that mean?
It's the fall under the category home
enterprises is your top category and
underneath there you have four types of
home enterprises which one can be a home
business one can be a professional uses
and customary home occupation one can be
home industry the other can be a home
office so those all fall under home
enterprises
and I get it because we use home in the
name three of the different we use home
four of the names so it's kind
And then they they say a homebased
business blah blah blah not being on
page 60
not meeting these standards shall be
considered a home enterprise. Well, it
is already considered to be a home
enterprise because it's underneath the
home enterprise. It's a subsection of
home enterprises,
>> right? Yeah, not meaning
that this article 22 does do
this falls on the four. So saying if you
don't meet if you don't meet the above
so if it so it's saying this home
any of the above standards which I'm
guessing is A through G.
>> Okay. So they've done it on their home
you're saying it's a home office.
>> Yeah they're trying. Yes. So it's not
considered a home office but it's still
considered a home enterprise.
But it's not like see how you have on
the
>> So I'm just going to make note about
that page 59.
>> Okay.
>> The A I don't mean to be but the A needs
to be indented and then B needs 7s.
Oh yeah, there's a lot.
>> No, no, that's fine. So, so what it's
saying my this is how my interpretation
is and I could be wrong.
Um basically does not mean anybody
standards are the standards 1, two,
three and four or they A through G,
right?
And it said, "No, it's got to be it's
got to be before
standards."
>> So my interpretation is that that is
that A through G are part four,
>> right?
>> And then that paragraph afterwards is
for everything.
>> Oh, see. So
>> I mean, but but it says it doesn't say
standards in any of the others, but it
says right here a home office subject to
follow standards. So to me the following
statements are A through G which are on.
So then I think this paragraph came
maybe I don't know I could be wrong
if it does not
>> I I don't know I'm just saying
>> I certainly don't
the new
yeah. So, so they're saying it's
catchify
is appropriate but it also but it also
refers to it says
so3
in the general next section. Okay,
it just says describing paragraphs B
through
it's all open to interpretation right
when you see that. So yeah, but I think
it would be if we could find a way or
Blair
could find a way to I like to simplify
and just have
I was kind of hoping he would simplify
instead of just giving us
nothing here. I mean, I had a chance to
look. I didn't fall in love with
anything that anybody sent us.
>> No, no harm. I was hoping for something,
you know, like a whole thing.
>> Brain it up and give us a new
brain power.
>> Okay. So, all right. So, what work needs
to be done? Well, on the brain parture I
see here here's so I was very happy
because we what this does the section 22
does with his home businesses is give us
power site review and that's nice but
home businesses see page 60 home
businesses are permitted in all
districts where single family residence
is a permitted use without the need
for special exception of additional
And I don't like that.
>> That's that's one that's your one on
your underneath your um home enterprise
home business and business pressure that
permits entirely within that resident
accessory building does not involve more
than occasional business.
>> Gotcha. So that's
>> it's just for that type of home
business.
>> Yes. So, are we happy with that type of
home business not requiring this
conditional use?
>> Yeah, I think that's fine because that's
that's almost like it's almost like I
would say like a contractor that my
company would hire versus me being I
work for them directly and I work I'm a
work I'm a remote work from home whereas
you know you're an IT person we contract
our IT services to you work at home but
your business
But all four of those subcategories
still require site review and that's a
good
you want to prove that they're actually
>> but without I mean everybody I mean I'm
just asking
I mean I think it's still I get
For me, it's kind of unclear because
it's like
for for when it comes to districts of
where it's allowed in districts,
especially when you start getting into
like other
businesses other than like the you know
attorney that uses his house as an
office because he's like I don't know.
So, so but but
it's calling out each of the time. So,
you have home business.
So, all the wherever we offer single
press.
Then if you look at the next one
which is two it tells our permitted
condition.
So basically they want to do that
except that's not
enforcement.
So I mean it is calling it up. It's just
when someone's not
a lot
>> we know
they know
that's why two things should be every
every business needs site plan review
and should we require permit permit
everybody that wants to open a business
whether it be well any of those any of
those categories to to get a permit
whether it be through us or this um
buildings. So that's my concern and my
other big concern is always the
abundance. I always feel but with a site
plan review correct me if I'm wrong I
think they have to it's a public hearing
where when we have a site plan review
are the buyers notified
I think so too but I'm not 100% but that
would be important to me right I mean if
somebody was putting business into any
one of us we'd want to voice our opinion
and I think any town would agree with
that as well
so we have that exciting plan with you.
Do you know what
you is for anything requires you to
host?
>> Well, we did a site review for the
for
doing a
we went to her
Was
it just a button
was there and everything else?
>> I don't think you notified anybody. So
maybe that's something I should look
into for the next meeting. So are so we
can spend online this.
I just want
maybe we should just stick with what we
have. we can stick
>> and just see if you can look at it and
sharpen up the instead of me to another
town.
>> I just think we're going to continuously
I think no matter what we write, it's
not going to be clear to
everybody.
>> So that's my opinion.
>> So that's a good point. So leave it as
it is or
>> I think in a lot of ways you have a
bigger fish to fry. I'm more concerned
about
the mentionings of ordinances or
mentionings of things in other areas
um
and cleaning that up. So like you know
Rob brought up the the campsite and then
the other one is um
>> that's okay. I get your point. So like
the permitted like so the Roxan brought
up at the last meeting like having a
list of like what is permitted versus
what's not permitted um or even like the
land. So like the lot size. One of the
things that Blair came back in my email
and said, um, you know, a few things
that we should have a discussion.
Um, one thing the board needs to
determine is the density allowed for
housing. For example,
will it be one unit per one acre, two
acres, 5 acres, etc. We'll also consider
how to address mixed use structures in
regards to density. Um when discussing
the above um the board is reminded per
HB
uh 1588 the town cannot impose more
strict regulations to a multif family
housing development in the commercial
district compared to commercial
development. For example, if the minimum
lot size for commercial development is 1
acre, then the minimum lot size for
multif family must be 1 acre or less. Um
the link above goes the exact language
of HP 1588. Um with regards to
manufactured housing parks, does the
town currently have any parks? We don't.
If so, the zoning must allow for
reasonable um opportunities to expand
the park. Does the board want me to
clarify minimum lot size in the housing
density and zoning ordinance? And I
think when he when we were talking about
like the minimum acreage and that he
brought up those areas, I think we need
to clean that up and focus on cleaning
up that jumping way ahead. I want to
finish this off.
>> We done with it. It's fine with me.
>> I think so.
>> Just leave that as it is.
>> I think so. I mean I think it's just a
matter of bringing again we don't look
at this every day but I mean I can sit
here and say okay this is what it's
saying
>> no we cler
tonight clarified in
my questions
>> I think we're fine if somebody came to
me somebody came to me for a
a restaurant in rural residential area
we would say no you cannot do that
that's only allowed in our business area
and
I just love
people ask
>> but you can see where that was
>> categories. Yeah.
If somebody wanted started making a
donut shop and creating mass units of
donuts, they could do that.
Just like
housekeeping
my ear. What do you do? Housekeeping
classes. Oh. Um. Oh, I had um asked the
OPD
um if we should have that. And then the
part about
it's really just something that says
that the the planning board has the
right to change the zoning ordinance for
formatting and all that stuff. that they
suggest that you actually put
>> so I was just bringing it up and I think
we should have
>> I'll make a motion that we put a
housekeeping clause in the
>> or does the town have to go around them
or is it going into the zoning
ordinance?
>> I don't think so.
I think
that you know there are going to be
they're not they're basically
A word might spelled wrong.
>> So
clause
>> anybody want to discuss it?
>> So I Yeah, I discuss one thing. Is it
just one? We just do one clause at the
end beginning or what?
All those in favor?
So, that will be just another one of
those things that she'll add to the list
of what you're doing.
>> Another what?
>> Another to-do for you.
>> Oh, yeah.
>> She's going to need a bid pretty soon.
Um, permissive ordinance.
>> I think this this is what we were
talking about. Yeah.
And I think something to say,
>> which is what I
had suggested that
>> actually I think Blair was going to
suggest some wording too. I'll get with
him. See exactly that should be worded.
I think it is too because
this is
>> especially for those people that just
want to know can I do this and it's like
that list
>> yeah the question
is
We do have that.
>> She has question.
>> I'm just asking.
>> Let's just get through this.
>> So I So yeah, I mean I think we should
add more things. That's what it's
called.
>> I'll make a motion meeting.
>> What is it?
that it's a permissive that
>> you just body of the ordinance this is a
permissive ordinance. I saw that.
>> Yeah. As opposed to prohibitive. No, it
it was what can be done and if it's not
there.
>> Yeah, it's not there. So, it can't be.
>> I'll make a motion that we add that to
the zoning.
>> Anybody want a second?
Uh, any discussion?
And then, um, let's just off camp.
>> Jeff, I already talked about that. Yeah.
I just wanted to
correct those corrections. I did. Don't
we have a whole section on like a public
camp there still? Am I wrong?
>> I thought we did.
>> Noah had actually pointed out two places
where it's specifically meant
>> it was rescended. Article is rescended.
>> That was private.
I don't see another uh there's article
of recreational
>> There you go.
>> That's noted
that
>> no.
So page 44
This actually kind of goes back to
you know
>> it's a good point because it is a
business because it would be somebody
>> does it say what district it's allowed
in?
Recreational
compound
should be located zoning district
classified.
So maybe that needs to be
well either that.
So I mean so I guess maybe our take away
from this is either
when you just go through those permitted
uses right
>> because it's like I mean even if you
look at this area
>> where it has like that whole district,
residential, commercial, and light
industrial. It has like a whole list of
like commercial uses.
You know how you really easily find
that you want to put
My feeling is I don't I don't know the
time want such a thing actually
they want it
well I know where they want to put it
but I don't think we would want it there
>> so I think I think this would just be a
takeway to kind of work through this and
come back
>> say decision
forward.
If not, then
you want to entertain a motion to public
comment up to this morning.
motion.
>> What was the motion?
>> Public comment.
>> I'll be pass
you know if you're enjoying the meeting.
That's one.
>> Yeah. No, I get I have
>> So motion was made to all those favor.
>> All right.
>> Yes. My name is Danielle by Sunrise
Drive where I
want to
>> do it. Thank you.
Um, so I am like just questioning um the
time frame whether or not we're going to
be getting our cults addressed um going
down Sunrise or Silver Street to
Sunrise.
The culprits are like caving in and
they're going to need addressing.
>> Residents are responsible.
>> So, is it a culvert that's on your
driveway?
>> I believe it's a it's a it's not in my
driveway. It's actually on the road.
It's actually coming from there's one on
on Silver Street and then one going down
Sunax drive and it's continuing after
the driveway onto the road.
>> I mean, I don't think those
last week. Silver Street. They didn't do
all
>> They didn't do all
but saying
I mean I can bring it.
>> Well, I know all the colors probably in
the silver street are fine because
>> Yeah, they just redid them.
>> They just Yeah, they just redid all
>> Yes, they look but I mean again size
streets do
>> no right.
I can certainly
>> Yeah. Along Silver Street, they're like
just caving in. It's like it looks like
it's just like all grass and dark. It's
just it's supposed to be like, you know,
and the town addressed it back in 2020.
Great.
>> This is specifically Silver Street and
Sun Drive or
>> um it's specifically uh Silver Street
and Sun Drive.
>> Okay. I just want to make sure I'm
right.
>> Y
>> Okay. And then also um I have a trailer
that has been recently condemned. Um
however, I need a place for storage. Um
and it does say that as long as the
property owner need unoccupied stored
camper on the lot indefinitely the
town's formal decision of article 14
private campsite which is not a private
campsite since everyone camper. Um, I
like just permission to be able to use
it for storage for storage. Um, because
it does say unless it's
not used as a private campsite that I
should be able to use that trail for
just my personal storage for my tools
and stuff like that. I'd like to take
the my shed, my storage that's in my
shed and take all the tools and put them
in my trailer so I can use that as my
indefinite
storage space on on
where it's been condemned by the town
and by code enforcement. I don't think
we have the authority
to make that decision. I think that
>> right. So, I did bring it to the town
last month and they said that I would
have to talk to the chief about it. I
did talk to have discussion with the
chief and he said he would have to talk
to Carl. Oh, I would have to talk to
Carl and I talked to Carl going back and
forth. He said I'd have to talk to the
chief and so it's like I should be able
to have somewhere to be able to use as
storage
should be able to use that storage. It
was indeed for the just for the reason
that it's not, you know, I don't have
like a current building permit enforce
and it can't be like designing in. So
that's why it was done.
it's not anything like ability to say
okay that's this is like a a code
enforcement,
>> right? It's not against code enforcement
though piece of car storage though is
what I'm trying to say like
>> but it just say if it's been condemned
and it's been condemned by the town and
the courts and code enforcement
and you're not supposed to go into it
because it's been condemned then that is
something that you need to clarify and
discuss with code enforcement because if
you're seen going in and out of there
uh but if it's used as storage I'm
meaning it's used I need it to have some
sort of like you know purpose and just
sitting there needs to be it's got to be
just use the storage and I have a plan
I'm using it for my tool shed
>> but that's where to take stuff
>> but that's where you that's where it's
like a you encode enforcement and you
and the police have to discuss it nacho
I we as a board can't
say oh yes you can use it for a shed
>> right
>> we can't say we we come up with
ordinances is
>> well as long as it's not reachable
>> and we present it to the people and then
the people of this town are the ones
that vote on it and say yes we want this
or no we don't want this like the
camping they said no we don't want
private campsites so there's no private
campsites
>> there's no camping at all going on there
at all so what I'm trying to say explain
is that I want to be able to use the
trailer for storage which I have that
right to do
>> so that's something that you need to
discuss with code enforcement and the
May I make a comment?
>> We don't have the authority. We don't
know how you would use it as a as a I
wish we did or not, but we don't. We
don't have any.
>> Well, what can I do?
But Christine, I think she told you need
to go a long
>> So is there is there any way I could ask
them to to contact me because
>> you need to you need to go and reach out
to Carl. So what I would recommend is
that you talk to Carol and G this
together so that all so all three of you
are in the same in same conversation.
That would be my recommendation.
>> That way you know I'm talking to one the
other
>> that would be your best
>> option.
>> All right. They should be able to send
>> Okay. All right.
>> All right. Thank you.
So, back up to seven
updates. I This is good news, right?
>> Uh yeah, the good news is um we don't
have to do anything until the letter of
determination is issued. So, we're in
good shape. And they gave us
>> part two.
>> Um part two,
>> we'd be Are they reviewing our
ordinance, updating it for us?
>> They making suggestions.
>> Making suggestions how we may have to
>> Yeah. And they also gave us a boiler
plate. So we can do either they gave us
a boiler plate too. I had
>> just one more question to clarify
because I want this
>> it's an easy one right
>> they will be have they given have they
updated our ordinance?
>> No.
Right.
Eight changes to development regulations
merger for season
already jumped up because he's quiet.
Well, I am because I want to merge the
properties
and the merger
is the merger is our development
regulations
I don't know does anybody want a copy of
what it actually says in 2.4 on page
three.
I've got it here along the
mustage
and it also has
>> it also has a copy of what we have for
the 2.3 meaning the development
requirement site plan.
>> Yeah. Isn't it confusing?
>> Is that really what that is?
All right.
you
Okay. So,
so all right. So, is it saying that
it's saying
required one, two, and three and then
this merging
That's how long
>> it's it says under the floor it talks
about subscription approval shall be
required for one two and three that's my
understanding it's a subdivision banning
lot track cost of land no we're talking
merger right no I know but I mean but
this falls under this
is it not fall under 2.4.
>> It does fall under 2.4.
>> Okay. But go ahead.
>> But they only talk about the merging and
consol consolidation lots
that last paragraph which is a number.
>> Yeah. And it doesn't comply with what we
require in our
permit.
>> Okay. So,
so you're looking to clean this up. I
would like to know. So how they were
doing it in Wakefield is they would go
to the land use clerk and the land and
say okay you got the two you got the two
you you own both properties you paid
your taxes. Yeah, we can do that. We
don't have to go for the planning board
for approval. As you know, I don't know
how many voluntary we've done as part of
the planning board. They come in filling
out this form, merging it, and you get
to go over and see whether they paid
their taxes and all and they own the
properties, right? So it's either way
you guys want to go you know I mean this
can be done by I prefer the planning
board to do it where
we don't have staff
anybody I mean we have a
>> right but Robert may not be you know the
next person may just be doing our
minutes out of out of the home may not
and the assessment would be different.
>> Yeah. So, so what you're presenting is
that you want what how what do you want
changing here? What you are adding? I
guess what I'm asking,
let's see
you perhaps we could just use the
language on the
language we have online.
It states the law completing the
application and
what the planning board will do.
But I mean the other idea is if you want
this to come to me actually.
>> Yeah. And I'm fine with that.
>> Well, because any kind of
property are we talking about just like
all mergers in general?
>> Yes. All right.
And the important thing is is that you
make sure that they own the properties
involved. I mean there has to be tax and
the other important thing to do is all
the taxes are paid up so there's no loss
of money to the town of
>> the mortgage.
>> I don't know about the mortgage
to be notified.
>> Yeah. Because the bank has to know that
you're changing.
I don't know where you're right Janet.
>> I don't I don't know. I never had to do
any I've done quite a few bridges on my
>> I've seen them now.
>> I've done as many properties as I can
and um it's a simple process. It was and
then there was there was another page
that I had seen that they given a reason
for the pricing.
>> you wanted to separate the pricing.
You wanted to make the pricing a
separate document from right now.
>> Yeah. Yeah. Yeah. That would be
separate, right? So So what is it off of
this page that you want in the
>> Okay. So we looking at the same pages
page three. I'm looking at
>> Yeah, that's the one I'm looking at.
Yeah, I think that would make a nice
little um
>> What? This whole thing?
>> No, not the whole thing. You ready to
type one up for the next meeting?
>> Yeah, I just What would you like to
replace?
>> I would like it to see per RSA 674
any
>> Well, no. So, right. So, I would say
yeah, what you think you would like for
this to be in here to replace this or
add to it and you can
>> Yeah. And the thing about All
right. I think
>> it's fun and I agree. I I really would
prefer from the board side support to
come through the discrepancy because the
this thing is telling you something
different than the things because I can
tell you right now by the time it is
especially something that's coming down
the assessment office we rely on
you know as to say yeah this is good to
go
because when we get it presented to sign
on it right we don't we're not going to
sit there and say
this all up.
So my thought is by the time we get it,
we know that it's been verified. You
need the date, you need the rece.
>> Is that again?
>> Oh, maybe.
>> Is it again?
>> No. envelope.
>> All right. So,
Soul Smart
I found I I got involved in um they they
gave me a deal. They said
they said um in exchange for um doing a
solar assessment on all the towns
properties and you have given everybody
copies of it and if not I'll make you
more copy and I thought and I thought
that would work. It's like a a jumping
off spot to get solar feasibility. Can
we talk about it?
>> I think
and I've actually met you were the one
that connected me to that girl from the
school board.
>> She
so um they went through our ordinance
and brought it and made some changes.
>> Recommendations.
>> Recommendations. Yes. Thank you. That'll
work. Recommendations.
about somebody else trying to change my
words because I feel like it's
beneficial for them and not necessarily
so I will say that
>> no that's
I'm not in
>> so is it beneficial for the town to do
so like the town buildings do solar was
there
>> well the school is a $30,000 a year
electricity bill it's it's got that
beautiful roof and that
solid exposure.
I don't know why
do that differently is changes
suggestion updates I should say
>> recommendation
>> no you're the most important you're the
most important one
>> so this is part of high obligation
>> because other towns didn't have a solar
ordinance at all. So they broke the
plan, right? So this is why they updated
it. And another part B of this is if if
we do go ahead with this and make those
changes um I've got a permit ready to go
and for Mr. Chief to review.
>> So you want us to review this? All you
have to do is read the
>> if you can read it. If you want a
different color that's fine.
the next meeting.
>> Yeah. If you don't want any part of it
or none of it or whatever that's fine.
Is there anything that they recommend us
take out? No. No. Oh, it's just okay.
Just additions like definitions. Um
>> so yeah, and I you take because you're
pretty about this stuff. So you can see
anything in here based on what people
have been thinking.
>> There were two things that I saw I have
to be honest with you. I saw that
somebody in this group might find
controversial. The first is on first
page number two to meet the goals of the
climate action plan
and somebody might have bridge with that
and I think
climate action
>> state climate action
>> we find out what that is and then
>> unless we have to have an Indian to get
>> we don't have to do anything to get they
already they I do that assessment. I
would say this is we don't know how long
the climate action plan is going to be
in place. It could be purchased by the
green tree plan next year.
>> So I would tend to
let's just get rid of it right now. Just
take
two.
The other one is rounded.
So we allow
the system.
>> Now these
>> Oh, no. No. I'm sorry. It's on our
apologize.
>> The solar panels, do they have to be on
buildings?
>> Okay. And if they're on the ground, you
can put parking underneath that doesn't
>> That's a good point. That's actually a
lot
>> because if you put it in parking, you're
not ruining the environment. It's
already parked.
>> Yeah. At at Stone Zoo, their whole
parking lot is solar panels, which is
kind of nice because you park under the
solar panel. So if it starts raining or
anything,
>> it is shade. But it's in shade,
>> but it makes use of an existing
structure parking lot. But
>> like using up more space
>> lumber yard on the roof instead on back
field space they have space trees
>> but they could I mean but now they are
kind of stuck because they can't use
that space for
>> but if they put it up 10 ft they don't
something I just saw.
>> I mean, I I don't know.
>> The schools go ahead and do that and put
it in the parking lot.
>> I mean, they do everybody in the parking
lot. That would uh I mean, that would
increase the parking that we have to
make sure that the uh do parking
outside.
I don't know. That's
>> Well, just that's you can put on the
roof that you say you have a nice roof,
but if they want to maximize the space
they already have without fields.
>> It's a great option.
>> Frankenstein.
So this is a copy of the one say you got
another one
I want to take not give away from all
the copy
>> I we're going to keep this over here.
No, because the question is is all
right. So now you look at the back of
your book. Did you get
I gave one at the bottom?
>> Is that so this? All right. Let me begin
at the beginning.
So if you open your books to page
one in our zoning ordinance talks about
the official zoning map.
Yeah. And it it's specifically says that
it must be kept in the municipal
buildings. Does it say specifically says
that? But it's going to be kept there
because it's the only place where people
can go come and go during business
hours, right? Because it's important
that they know what zones they live in.
So I was hot heavy on the village
district a couple months ago. Remember
that? So that's why the that's why this
this is this is sunrise zone.
So, and then here are the other zones.
Use the business zone.
I had to
shave in. This is melting four corners.
But what this doesn't have is that
complicated.
>> I know. Why is it complicated?
You guys are going to make a decision
do you want
this map
to have all of the rural residential not
have a lot. It might be helpful to have
four quarters in the business district.
Now, there's another thing you have to
think about
2006 to 2006. I was not here. I was on
the board. I was not here. And
for some god awful reason, they split
lots between two different zones.
>> And I do you still have the the minutes?
>> I have them at home if you don't, but if
you guys want to read the minutes,
>> and I don't have all the minutes, but
there was a reason for one part of it.
You know, our um the aquifers down here.
So they put some in the business
district and the rest they kept out of
the business, you know, business
district I think because
I I can see where they split, but the
the rest of the splitting
this has this can only be updated by a
public hearing
by public hearing. zone and we have six
zones
of water. Sunrise lake is a zone.
Sunrise lake district,
rural, residential,
residential, commercial,
industrial.
That's that.
Oh, but I want you to know I want you to
see if you want to change this because
the original the original map that lost
that somebody think it was
important.
This was the This is how the original
map.
This is the one that's
>> Is that the one that's still online?
This is the map that's
>> And there's a little one over there, but
there's not a big one hanging on the
wall.
>> You want it on the wall, Kate? We have
this one on the wall. I know. I like to
do
lots on it. I also have the um Scrapford
regional spreadsheet with all the maps
and what zone they're in. And some maps
are split between guys want a copy. I've
got to send I didn't send that to you.
I'm sorry.
>> I don't even
>> No. So I think that's I think that's
useful information.
>> So I think it would be useful to get it
on our website.
But I'm just saying so I think have this
information
>> where it needs to be available in the
school building but also you can get it
online
the list.
>> Oh, the map.
>> Yeah, the listuge
spreadsheet that's going to be just
>> But I'm just saying that I think it's
useful for I mean
>> Yeah. Oh my god, is it useful? Yeah,
because people are going to be mad.
>> Well, because people have questions
instead of coming to us and saying like,
"Oh, I need the answer for like
>> I need to know
the map. It's on
>> the map is online."
>> You want to add
the map on
Is everybody good with that?
And the final my final comment
>> on this commission.
>> Is that where there were questions about
where the zone is
the ZBA?
Yeah. Boundaries article four.
It tells you where the boundaries are
and the resulting board of adjustment
shall determine publication. The
district boundary
appeal administrative.
So if somebody says like I told you on
that map, look closely.
I don't like it. I wish they all
required
by the perimeter of the law, but they
don't. And to change them, it would
require a public hearing.
>> So maybe something on our
think about. I mean, I agree. I agree.
After we have something split, that just
means they want more.
>> I know that why they did that in one
instance where the aquapor is set. They
didn't want they wanted to keep some of
them in the business because you got the
guy who signed business there.
that the business owner
comment 11 the uh updated votes
>> seven I ordered voted them and I voted
um then online copy where I download.
We're going to get a code to download
copy too if you want. I try not to get
too much paper. You guys been lo for
>> this many trees hills love
>> when they ran out
membership
>> legislates updates
>> just that there is a webinar on the 20th
and know you guys are all interested in
the is due. So they're going to be going
over that
>> hour of the webinars.
>> So they'll let all the land change laws
change all the
sign.
>> I can send the link of it again to you
guys if you want.
No, I just I
just
I'm going to try to be on it. Something
else.
>> I'll try the 20th. That's on Thursday,
>> Yeah. Thursday.
>> Well, it's time
>> I think it's going to be 12 to I think
it's be 12 to 1:30.
>> Next week. I'm pretty sure it's 12 to
1:30. They expect it to go longer
because of all the
>> if you sign up for it, they'll send you
the link anyway.
>> Hey, you and your boss watching
So I got a question here.
So building
exact location
number
maybe it doesn't have a number
>> I can't imagine something on drive
doesn't have a number
>> which is it
>> yeah where is that
building for a short time.
>> I wonder.
>> Well, I wonder if it's um
>> Kate's got to get off.
>> No, it it could be them finishing up.
>> Um
>> Good point.
>> That little blue house,
>> but it's not new, is it?
>> I mean, I wonder if it's still like
going in.
>> Yeah. Why does that happen?
>> Because I know a couple of months ago
the second I was getting the uh tax
bill. It wouldn't have number.
>> Oh, it would. But I I don't know why it
doesn't have a number on it.
>> That's that's my only question. That's
all I have to
>> Yeah. No, I'll find out. May it's
possible I applied for it already. I
don't know.
>> Maybe we're just waiting for it.
>> I'll find out.
450
>> 48.
>> I can't see it cuz my eyes are so bad.
>> Oh, wait a minute. Oh my gosh. What?
>> No, it's way over there by
>> Oh, yeah. I can't believe it.
>> I didn't think there was any opens down
It's got a short.
>> It's amazing.
This could be
>> straight edg.
>> Oh, that was I know exactly where that
is.
>> Exactly where that is. That's right.
Do you have any mute?
>> So, somebody help me. Is that six
building permits? Is that six?
only two two houses.
>> Yep. So July last year.
So we're at five 10. So we're at 13
houses so far this year. This is an
important one. pursue
it. We probably spent maybe to go down
training to go
Yeah. And everything else
>> they report. Yeah.
Report.
>> Yeah. Just haven't and the billion.
>> Can we all get a copy of the financial
report?
>> The next meeting.
>> I could fix it.
>> What?
>> Oh, if you could add.
>> Is Is Kim going to do that every month
now?
>> She should be.
Well, I typically when I come in, I
usually do both. I get it, but I mean to
add to the
I can't imagine that's a big deal.
>> It's usually one.
>> I mean, what will happen is you might
get the whole report because she's fig
just like because we're using new system
NST, NTR, NTS, whatever it is. Um and so
you might get the whole thing
working on that.
I got a few things I want to say.
>> What can we start down this sentiment
first? Can I get to you?
>> Last but not least.
>> Well, no, but I'm just saying to you
forget
>> she knows me.
Um, I don't really have any comments
other than I like this format. I like
this. I like the stuff that's down at
the bottom now because we don't get into
those.
>> It's a team effort.
>> So, I think that's great. And yeah, I
want to get a portrait tonight. So,
I appreciate everything
without
>> a little I'm not on my
>> Can we give her a bonus?
>> We'll do that.
>> Can I mean she doesn't work for us, but
I mean like because it was such a
because it was such a a year with all
those updates and amount of time she had
to put in to get this all up to us. I
don't know. I don't know. We're just
asking that question.
>> I mean, you could say look at the budget
and say
I mean I'm just saying
>> but I don't do the selective groups that
be a selective.
Thank you. Well, and as time goes a as
we move forward with our work with Blair
and as we go down through the contract
money that's already been spent paid for
and we can look at what we can start
assessing what we have left over in the
current budget
and then
process
something.
>> It's not every year as bad as this year.
we can make it not as bad because that's
ridiculous.
Second thing I raised a great point a
couple of meetings ago about Christine
about surveys for the master plan. Do
you kind of I mean I know you talked to
Janet she'll be listening to this. Does
she have any idea where those old survey
questions are?
>> No. I can get some very old survey
questions, but that last would be
crucial to see whether that, you know,
it would be nice to have those survey
questions in the results.
>> Yeah, she that's out there.
>> I think she was like just getting back
into the planning board
around the time that all that was done.
>> And I don't think there's
>> Well, she was on Well, Bronx
master
That was what four years ago2
questions
have to do with you know like
sort of How do you stay health?
>> Oh, you're looking at
>> Well, and and I think it also talked
about like
>> and I remember it asked about I remember
when I was doing the like I took the
survey it asked about um like what you
had envisioned for the town like staying
small and rural versus like grow growing
more and
all of that.
>> But yeah, it would be nice to get that
because to be able to that that's
evidence, right?
>> So, final thing is
like Yeah. I think there was an online
and then there was a postcard that went
home and I think it said on the postard
>> that's great.
But I I would like to have like that
information because I feel as though
when we're doing our ordinances is that
we should keep in mind of what the
people
absolutely
>> of this community are wanting and that's
kind of like the best way to do it. I
>> I'm sorry.
>> All right. So, wait a minute. How I
agree, Christine. That's why I brought
it up and that's why if we can find
those old circuits because I have some
very old ones without
>> Well, and it's just nice when like
somebody comes up and they're upset like
oh why did you you know you did this
board and it's because
you know you wanted um you know
oh yeah whatever I say like no but when
we discuss things and when we come up
with things we do it because we're
keeping in mind of what people want the
last time we heard
what the census of what the people want
and is now that survey. I don't think it
would be a bad idea to do surveys
periodically.
>> I mean, we should do it by mail, but
also
>> we should do an online survey that
>> that would be more of the audience
moving forward.
>> Absolutely.
>> Fine. But
>> well, the one I did, they put it out
online and they did it um I think by
mail. The only thing I don't
I have mixed feelings on the online is
anybody can do it.
So like any and it would allow you to do
it more than once.
you know I wonder like how accurate and
I just worry about like random people
like especially the link would get I'm
sure distributed through Facebook. I
would like to contract
original as well.
>> Yeah. What's the
>> more to do the salvation? I wonder if in
your conversations if you could what's a
ballpark here updated
is that you is that the oldest one we
have?
>> What's the what's going on neighborhood
survey guards mailbox?
>> Well, that's it. But I'm just saying,
you know, you wor about the online
security, the physical security is just
just as nefarious.
>> I mean, if you want to just say, "Put
your name." I mean, I can write anyone's
name on there.
>> It's a guide. It's not It's not a
>> It is not an absolute not a voting
registration.
>> People tend to think what we have is
pretty special. We want to keep it that
way.
That's all we're trying to do. It's not
easy. Well, with wind once you do
something to it, it's never the same.
So, so just real quick, this is zoning
ordinance. I went through and really
we're get I mean I didn't notice all the
campground sites, but on each page, this
one I'm looking for a form. I don't know
if we have a home businesses form. Uh
this next one, the density and minimum
dimensional requirements. Where is that
located? Is that in the capital? Is that
in the um development regulations?
Home based contract yard as per article
3 table one I couldn't find the table
maybe it's a different I just missed it
registered anybody contract yards
registered 20 there's more to it than
based contract is that there no
chart
Yeah,
>> you put your truck, put your equipment,
you put your tools. I mean, yeah, you
put your junk, but you know, you have a
landscaping business heavy lawn mowers.
>> It's fine.
>> I mean, it's just just a and then this
is 100. I don't know how we're going to
address that. All industrial use is
located on
>> Oh, that's probably is
113 there's a couple of rolling
business
again
finding mistakes.
>> Yeah. And I think some of the stuff is
exactly housekeeping.
>> And then section 36 I think the
reference should be article 44. Somebody
needs to verify that correct.
>> So we actually had on here page 59 right
>> which where we said under four where we
want it it's just this is just more
home
I'm glad you found that out
>> that's what you already pointed out
>> yes I'm probably Yeah. No, that's good.
That's
all.
>> All right. Our next regular meeting is
>> Oh, want to talk about Airbnbs?
>> Sure. We can talk about Airbnbs.
>> So, would Airbnbs go under your
businesses?
This is what I know and I'm a genius. So
it's males and groups tax is 8.5% in New
Hampshire.
That money that is collected by that all
goes is shared throughout um all the all
the towns and cities in New Hampshire as
far as I know. Correct me if I'm wrong.
And so we must be this town must be
getting revenue.
>> Yeah. And so one of the one of the
arguments for having a B&B
show
is that it's not um fair for businesses
and other people that have registered
as one of first steps they must take to
have the rooms and meals. In fact, if
you opened up a small restaurant, you
have to get that room and
But anyway, so like
for $3,388
you can get a fiveday rental.
You can go to Burbal and you can go to
Airbnb.
There's lots of them.
I didn't even try.
So the other thing is too with saying
Airbnbs and doing an ordinance as well
is that making sure for like health code
enforcement
for example like if you have a
two-bedroom house and you can say
because I've done Airbnbs before and you
know how it is if you've ever done like
rented at one where it's like it says
sleep And it's like, well, four people
might be in the living room because
there's like two pull up couches and
then everybody else is like, you know,
three back bunk beds and, you know, the
two bedrooms. Um, but I guess per I have
somewhere there is an RSA, is it an RSA?
There is a rule or law that it can it
has to
Your air your short-term rental has to
can only occupy the amount of people
that your septic can handle.
>> So if you have a two-bedroom septic
system, you can't say we have 15 people.
Like it can see 15 because a two-bedroom
septic system generally speaking and
this is what I read. Yeah. And you could
be wrong. It's four people. And they
will also count a den. Anything that's
four in a closet
would be considered to be a bedroom. So
you can't count a den as a bedroom.
>> No, you have to go according
>> what you're saying is some people will
say, "Well, that's not a bedroom. It's a
den." They will still count it as a
bedroom if it has certain
qualifications.
So that's something to think about,
something clarify. So I will tell you
last year
we got meal with the meal
we got 365
that's pretty good.
>> What is it? 365
>> 365 almost 366,000
3658
which
>> and as far as I know is distributed
equally to every town city I don't know
>> well I'm just saying I don't necessarily
know because I was kind of surprised
when I first came on that we got I'm
like well we don't have any hotels and
restaurants whatever but It's the it's
distributed equally. I can't verify
everything I said because I was just
looking
I was getting into it.
>> Now the ordinance you speak of about
septic tanks is that ordinance or
statements?
>> That's a state thing.
So it's already books
>> the you know septic break
that's state
>> that's why
we don't have we don't have
a lot of shortterm rental so it would be
on our
>> so when the state changed it we'd have
to update
about the state based I mean sorry
anything not in here is based on what
state correct
>> I don't think as a president
>> not public
but I mean Christine's comment was
basically saying this place 15 people
technically that subject cannot see to
handle 15 people. Is that what you're
saying?
>> And I don't agree with her on that.
>> Right. Where did you see that? So, that
was um
>> I'm going through my the email to find
it because
I got someone who was concerned because
there's a short-term rental in a house
um she was concerned because the amount
of people that stay in that short-term
rental, she doesn't feel as though that
the can't separate can handle it and
it's right on the water and she's like
this
potentially like the health and safety
issue, which I agree. Um, and so she was
wanting to know if you know we had an
ordinance and what, you know, we can do
and all that sort of great stuff. Um,
>> two questions.
>> I mean, are the there an excessive
people there all the time or just
>> Yeah, she said basically it's a water
property. So basically from the start of
the season to the end of the season it's
>> working
out a year have a lot of people
>> but you could still overflow your system
in a short time
>> certainly can overflow the a lot of
people I know a bit longer.
>> But if it's on the water and it's it
flows out into the lake,
>> it's but by that point the damage is
done. Okay. The septic system overflows
and there's literally crack in the lake.
Well, yeah, it's on the owner, but the
rest of the people in the community, the
health and safety of the community and
the damage is done. And so therefore,
are you we have a code enforcement
officer, we have a health officer, you
know, do you become proactive
and look into proactive ways?
>> So, okay. So, but where did you you said
someone asked about you? But it's not
safe or anything. I think that's where
the information
>> res
I can't sign it right now. Okay. I was
just curious.
>> Yeah. I can't find it, but
>> we could look for that. She's not a big
deal tonight.
>> That's curious that it would be.
>> Well, then I also asked Carl about it
because like then we got involved
because I was like this isn't a me thing
or a planning board thing. It's like a
code enforcement.
If you have concerns about it, this is a
a code enforcement issue. Um and then I
had to ask Carl. I said, "Well, what is
the like how many people
Because if you have two bedroom,
especially if you have kids, it's like,
okay, you're you and your spouse are in
one room and then what if you have like
two or three kids and they're in the
other bedroom or like is there a number?
He actually did give me the
number per bedroom.
I thought it was two. I thought I read
it was two, but I'm
>> I forget what he and I have it somewhere
like
circle back.
>> Yeah. And I got one one more thing. On
one of these Airbnbs, they gave a um
they gave me a review and the title
caught my eye. I've lost sewage.
Yeah. Yeah. So the following morning we
had sewage began to flow throughout the
entire downstairs.
>> Oh my god.
>> Yeah. Yeah. We decided it was unsafe for
the house. So we left the bed.
My father was called,
the host never responded. We turned it
at the property, blahy blah. They got
50% back, whatever.
But they still gave us 610.
>> Oh, yes.
>> It must be a great view.
>> It is a great view. That's what she
said.
But
>> but it just tickled me that they gave
him a six out of 10 even with all the
ros.
>> Well, and and I've been thinking a lot
about because budget committee and
planning board and stuff and it's like
I'm I don't want to be like the Karen or
like the stop and come down and be like,
"Oh, we've got all these rules and
laws." But
thinking about the spirit of what our
town and community wants and how to keep
and maintain that. Unfortunately, I
think it takes
certain ordinances and certain rules or
laws and then it it takes the money as
well and the effort to put into it. And
so it's like if you want to keep yours
if we want to keep our town small and
quiet and quaint the way it is, then
unfortunately like we as a community are
going to have to decide, you know, do we
handp
the money and then the resources and the
ordinances to protect that or if we
don't we potentially lose that.
>> I got two things to say.
>> I want to say two things.
The first thing is
for now the first thing is
we've already had one complaint somebody
from the league was concerned about
putting too many people
ask people ask around
maybe Um
there's a conservation commission where
develop a Facebook page for us which is
exciting but I'm also concerned about
the negative comments. I don't need
the Middleton
Facebook page
questions out there
too much. Is it too much? That's fine. I
just I just had that idea.
I remember we had a previous
conversation about 70
all days.
It's up to the home.
They have to make economic decisions.
Well, not just the way I mean there's
>> but I mean I'm not saying it's the lake
everywhere but I think our biggest
potentials
because those were all right and and
guess what
>> you said two
um holding tanks how many of those camps
around the this lake actually have a
septic system
they probably just have that
barrel at 355
trucking.
But yes, it is up to the property owner
to be responsible for their property and
what happens to it. But at some point,
which is why we have health officer code
enforcement is do you let it get to the
point where it affects the entire
community or do you put certain stuff?
>> No, we're trying to reduce the
phosphorus like by 30%. But but you know
is it but is it our like duty
to put in certain things in place to
prevent things from becoming out of
control which is why laws and ordinances
and everything else are put into effect
is to protect the surrounding people.
Their health the number one thing for
planning were health.
>> Right. That's why safety that's why
their distances
other fire and then set back
from
I'll make a motion we adjourn the
meeting at 7:48
in favor.
