Middleton Planning Board Meeting - 12 August 2026
The Middleton Planning Board met August 13, 2026. The board approved July 16, 2026 meeting minutes on a motion with all in favor. Discussion focused on updating 2027 zoning ordinances, specifically Article 22 regarding home enterprises, definitions of home offices, and zoning district inconsistencies with campsites. A motion carried to add a "housekeeping clause" to the zoning ordinance for formatting corrections. Public speaker Danielle from Sunrise Drive mentioned deteriorating culverts on Silver Street and asked about using a condemned trailer for storage; the board advised she discuss the trailer issue with code enforcement rather than the planning board. I think I signed I think I had signed some but I was also looking at I'll follow that when you say are you talking specifically don't it's only the only two conservation commission or not the planning board is the most important anybody can I know we all say that it will be the minutes but without taking that oath of office it can be an issue I'll follow that but I call signing 812 and if you want me to go my way back I can tell you exactly why those open boxes are very important. So for budget committee and those positions you have to be not just a resident you have to be a registered public as well. So the select tax collectors, >> but yes, you need to be registered. She must be and even if you got appointed on the other >> well be elected I don't know resilience. >> All right. So number six, I guess we're on um voting ordinance reviews and updates for 2027 home prices. Um clause. Um so Blair sent us >> words. I don't know. this past month has gone by somewhere. >> So, because I'm the one that brought up because I had a very difficult time article 22 and understanding how it pertains because if we go through our zones, >> each zone spells out what can be in those zones. Yeah. Home Enterprises says these people are four things. Businesses, professional users, home industry, home office can be in these zones as well if they have an accessory use. So I'm getting a better sense of how we supposed to use this. There are some confusing points. I just wondered if anybody else has the same issue. Maybe this is a nod to most everything along with it, but I don't I didn't find anything. What What was the town trying to do? I think it was in response to getting home offices and businesses in a rural residential area and obviously get out to four corn as you can. It could be one to allow a little bit of a balance. >> No, it would be to allow people who wanted to work out at home. industries is a bit >> scary but you can put those in >> and then the other thing was so I'm just not saying this is an issue >> for all of us maybe it's just me I kind of struggle with it too because it's very vague and you can only obviously like you can only list so much stuff um and of course the one thing that's not going to be listed that person's going to come forward and want to do and that's just how it goes. And so then you're kind of like left in the middle trying to figure out if it's appropriate for that area. >> When was it written? It was done in 2017. The reason I asked is that was precoid and during that during that time a lot of people home that had never done homework some were successful some were not but the home business has been transformed since then that I can work at office and at home and work with them to California >> but I think it depends on like what you consider like a home business is like I consider somebody like Roxan or myself I don't consider Home office. >> Yeah, >> I mean that's what I was saying to work on except for shall be seen at the residence area. >> I think that's what everybody Right. >> Yeah. >> Like I think all the people that are and they really it's like a remote worker here. So which to me is also similar to well when we go look at a home business that looks like you're actually working the home business I guess I would necessarily I would consider a home office because he didn't work out of the house and he didn't do business out of Yeah. >> It's just you know truck there and his tools, but then they probably sitting in his vehicle because he needs to go or whatever. And the only like business that he probably does is probably like bookkeeping business like >> part of the job. You need place to do that. >> He doesn't need to have he doesn't need a rented office. Yeah. So whereas the home business is a trade that's conducted by the resis and what isn't what is allowed. >> Does it still make sense? Well, so that's right. So, for example, like in the Lake Village district, it's only for like single family homes, >> essential services. >> Yeah, services. And so for that, it wouldn't be allowed, but then they can come forward to the planning board for. But then it says accessory uses. And if you look at article 22A, each of the four categories categories conducted as an accessory to a res to a resial use. What district see So I don't know what that means by >> well if you go back to each stone the pages and seven village district. So, >> so we actually, so we got to start back at section eight. I basically said what where you can have uh home enterprise. >> Well, just those four things, >> right? No. So, that's what I'm saying. So, >> yeah. So well even like for like the basic district use so rural residential district permitted uses single family houses two family houses farms and agricultural operations and then it's like where's >> sales products essential services backs are allowed um accessory uses >> right but so what does management or or do we say in we say in these different districts what he's allowed and what he's allowed. So I guess that's what we have to I think that's a big discussion that we have to talk about tonight is the fact that I think each ordinance whether it be like ADU business whatever when they've gotten done I think everyone hones in and they focus on that one ordinance but then leaves out they forget about the rest of the ordinance. ordinances and where verbage falls in those areas. >> I think a good example is campsites. We took out the campsite ordinance and because ours is permissive can't have campsites since it doesn't say we can but campsites is mentioned in two other places. So yes, so I guess so we would yeah so anything that we say effective meaning we took out the canc right >> so is the idea to say okay here are zoning or is that is our we have our last stand so say we get to this article 22 which is enterprises are we looking to say like in in article 22 these these following are we are we looking to say in the ordinances these are allowed in these districts in these part my response would be these are already allowed in the middle corners in commercial business. So where it says like Sunrise Lake District and then it says permitted uses, would you put under permitted uses all the things that are permitted like all the ordinances? So would you put like home enterprises if you wanted home enterprises in the like district or you put it in the rural residential or like put it there because when someone says when I contacted and someone says to me I want to open up a salon or I want to open up a doggy day here or anything I always say please refer to the town ordinances but then I also say um you know not just review your town ordinances but then like look at you got to look at what district you're in so I think if the it may be helpful for people if when they realize it and they say like okay what district am I in they look at the district map and they realize like okay I'm in the sunrise lake village or I'm in the sunrise lake district and then it goes out permitted uses and if we have all the things that are permitted then they sit >> because accessory zone these are home enterprises apply to zones that have conducted as an accessory use right but they I home occupations I don't think anybody who had any problem with anybody. >> Well, and then it starts and everything like that businesses and traffic. >> So, well, and it does say here for like like district accessory uses, a customary accessory buildings uses, um, home occupations according to local covenants and oral regulations. Um, which I really hate that because >> I love it. Well, no, but we can't enforce it as a planning board. >> So, actually, I thought that they put that in there specifically so we could so we could look at >> we cannot according to NHMA because I had saw that and I was like, "Wait a minute." And I contacted NHMA and NHMA is like, "Uh, no, you cannot." >> So, I'm like, "Well, it's kind of contradicting." >> Well, then I would ask NHMA a different question. say how can you so we can figure it >> you can that is my answer you know that >> I have I can go through and I can pull up an email >> I want I want to see what they said >> but I mean it's also >> because that wasn't in there before and I'm assuming they added that just so you would have to consider the compan so circle back to conversations What we were looking at is home enterprises. are we trying to I guess I'm just trying to >> Where are we? How do you want to move forward on these as far as saying do we say within here? Do we say I don't know what you what is it that you're having? My my first of all my problem was I wasn't clear on the difference between a whole enterprise and a whole business. That sounds ridiculous, but it's true. Well, because they do talk about on page 60 they say a homebased business not meeting and not meeting anyone standard shall be considered a home enterprise. Now that what does that mean? It's the fall under the category home enterprises is your top category and underneath there you have four types of home enterprises which one can be a home business one can be a professional uses and customary home occupation one can be home industry the other can be a home office so those all fall under home enterprises and I get it because we use home in the name three of the different we use home four of the names so it's kind And then they they say a homebased business blah blah blah not being on page 60 not meeting these standards shall be considered a home enterprise. Well, it is already considered to be a home enterprise because it's underneath the home enterprise. It's a subsection of home enterprises, >> right? Yeah, not meaning that this article 22 does do this falls on the four. So saying if you don't meet if you don't meet the above so if it so it's saying this home any of the above standards which I'm guessing is A through G. >> Okay. So they've done it on their home you're saying it's a home office. >> Yeah they're trying. Yes. So it's not considered a home office but it's still considered a home enterprise. Oh yeah, there's a lot. >> No, no, that's fine. So, so what it's saying my this is how my interpretation is and I could be wrong. Um basically does not mean anybody standards are the standards 1, two, three and four or they A through G, right? And it said, "No, it's got to be it's got to be before standards." >> So my interpretation is that that is that A through G are part four, >> right? >> And then that paragraph afterwards is for everything. >> Oh, see. So >> I mean, but but it says it doesn't say standards in any of the others, but it says right here a home office subject to follow standards. So to me the following statements are A through G which are on. So then I think this paragraph came maybe I don't know I could be wrong if it does not >> I I don't know I'm just saying >> I certainly don't the new yeah. So, so they're saying it's catchify is appropriate but it also but it also refers to it says so3 in the general next section. Okay, it just says describing paragraphs B through it's all open to interpretation right when you see that. So yeah, but I think it would be if we could find a way or Blair could find a way to I like to simplify and just have I was kind of hoping he would simplify instead of just giving us nothing here. I mean, I had a chance to look. I didn't fall in love with anything that anybody sent us. >> No, no harm. Well, on the brain parture I see here here's so I was very happy because we what this does the section 22 does with his home businesses is give us power site review and that's nice but home businesses see page 60 home businesses are permitted in all districts where single family residence is a permitted use without the need for special exception of additional And I don't like that. >> That's that's one that's your one on your underneath your um home enterprise home business and business pressure that permits entirely within that resident accessory building does not involve more than occasional business. >> Gotcha. So that's >> it's just for that type of home business. >> Yes. So, are we happy with that type of home business not requiring this conditional use? >> Yeah, I think that's fine because that's that's almost like it's almost like I would say like a contractor that my company would hire versus me being I work for them directly and I work I'm a work I'm a remote work from home whereas you know you're an IT person we contract our IT services to you work at home but your business But all four of those subcategories still require site review and that's a good you want to prove that they're actually >> but without I mean everybody I mean I'm just asking I mean I think it's still I get For me, it's kind of unclear because it's like for for when it comes to districts of where it's allowed in districts, especially when you start getting into like other businesses other than like the you know attorney that uses his house as an office because he's like I don't know. So, so but but it's calling out each of the time. So, you have home business. So, all the wherever we offer single press. Then if you look at the next one which is two it tells our permitted condition. So basically they want to do that except that's not enforcement. So I mean it is calling it up. It's just when someone's not a lot >> we know they know that's why two things should be every every business needs site plan review and should we require permit permit everybody that wants to open a business whether it be well any of those any of those categories to to get a permit whether it be through us or this um buildings. So that's my concern and my other big concern is always the abundance. I always feel but with a site plan review correct me if I'm wrong I think they have to it's a public hearing where when we have a site plan review are the buyers notified I think so too but I'm not 100% but that would be important to me right I mean if somebody was putting business into any one of us we'd want to voice our opinion and I think any town would agree with that as well so we have that exciting plan with you. Do you know what you is for anything requires you to host? >> Well, we did a site review for the for doing a we went to her Was it just a button was there and everything else? >> I don't think you notified anybody. So maybe that's something I should look into for the next meeting. So are so we can spend online this. I just want maybe we should just stick with what we have. we can stick >> and just see if you can look at it and sharpen up the instead of me to another town. >> I just think we're going to continuously I think no matter what we write, it's not going to be clear to everybody. >> So that's my opinion. >> So that's a good point. I'm more concerned about the mentionings of ordinances or mentionings of things in other areas um and cleaning that up. So like you know Rob brought up the the campsite and then the other one is um >> that's okay. I get your point. So like the permitted like so the Roxan brought up at the last meeting like having a list of like what is permitted versus what's not permitted um or even like the land. So like the lot size. One of the things that Blair came back in my email and said, um, you know, a few things that we should have a discussion. Um, one thing the board needs to determine is the density allowed for housing. For example, will it be one unit per one acre, two acres, 5 acres, etc. We'll also consider how to address mixed use structures in regards to density. Um when discussing the above um the board is reminded per HB uh 1588 the town cannot impose more strict regulations to a multif family housing development in the commercial district compared to commercial development. For example, if the minimum lot size for commercial development is 1 acre, then the minimum lot size for multif family must be 1 acre or less. Um the link above goes the exact language of HP 1588. Um with regards to manufactured housing parks, does the town currently have any parks? We don't. If so, the zoning must allow for reasonable um opportunities to expand the park. Does the board want me to clarify minimum lot size in the housing density and zoning ordinance? And I think when he when we were talking about like the minimum acreage and that he brought up those areas, I think we need to clean that up and focus on cleaning up that jumping way ahead. Um, I like just permission to be able to use it for storage for storage. Um, because it does say unless it's not used as a private campsite that I should be able to use that trail for just my personal storage for my tools and stuff like that. I'd like to take the my shed, my storage that's in my shed and take all the tools and put them in my trailer so I can use that as my indefinite storage space on on where it's been condemned by the town and by code enforcement. I don't think we have the authority to make that decision. I think that >> right. So, I did bring it to the town last month and they said that I would have to talk to the chief about it. I did talk to have discussion with the chief and he said he would have to talk to Carl. Oh, I would have to talk to Carl and I talked to Carl going back and forth. He said I'd have to talk to the chief and so it's like I should be able to have somewhere to be able to use as storage should be able to use that storage. It was indeed for the just for the reason that it's not, you know, I don't have like a current building permit enforce and it can't be like designing in. So that's why it was done. it's not anything like ability to say okay that's this is like a a code enforcement, >> right? They come in filling out this form, merging it, and you get to go over and see whether they paid their taxes and all and they own the properties, right? So it's either way you guys want to go you know I mean this can be done by I prefer the planning board to do it where we don't have staff anybody I mean we have a >> right but Robert may not be you know the next person may just be doing our minutes out of out of the home may not and the assessment would be different. >> Yeah.
