The Albany Select Board addressed Sandwich's restriction of beach access for Ferncroft residents. use of the sandwich beach for the ferncroft residents and before we start i want you know we did try we did for my and i'll just give you a little bit of history of what we did since we got this um we wanted to attend a sandwich meeting to discuss it with this letter i couldn't get on the agenda so i finally got a call from the chairman chairman chairwoman and she said that there's just no way to reverse it and she said it was never the deal and she said the reason being from what i understood is there's been a lot of people using the beach and in an effort to slow down the traffic and the use of the beach someone in the sandwich office I don't know who it was suggested that the permits don't cover I don't know how all of a sudden like that this happened I don't know who what was the traffic situation I think there was traffic everywhere there for a while i think this has a lot to do with the whole covid and like rick was saying i think everything went a little crazy and they looked for some way to control kirk hill it and i think that we were put on the chopping walk um i asked if there was some way to renegotiate they basically didn't want to hear it i hit a brick wall we talked to our road agent curtis callman um if there was some reason that we could negotiate that we need the beach to be part of this deal but they're not getting extra out of it we're saying they we would get out of something more but we don't have more to give we plow with a certain stretch of road and this is what it's worth to them is giving up the dump but not the beach so unless you guys want to stay something i'm going to open the floor to uh no i did um when i reached out as well i'm the town administrator lisa hans i reached out to their town administrator um and she said the same thing basically they just have too many people someone in the office realized that a long ago these dump stickers also serve the beach and that they never meant to have the one of lancet residents have beach access this is what she told me um i offered you know can we make a deal can we negotiate absolutely not i got the same restaurants as kelly they just will not play ball with us on this one you want to say something right before we yeah in 2019 we had a meeting up at the chapel um that meeting with the subject was brought up and i thought we had clarified it we had researched it back then um i know i spoke with steve knox because he was still around um and he remembers it being a swap for plowing and maintaining the sandwich ferncroft section in exchange for the people out there who are mostly seasonal people at the time uh to use the solid waste facility or the dump or whatever you want to call it um and it's in the minutes of that meeting um and is the minutes over there yeah i mean they're in the minutes of the meeting curtis was at the meeting um and that's what we understood it was a question at that point though it was somebody asked about it and we researched it we couldn't find anything in writing you know it was back in the old days everything was done on a hanshry that's the way in the hampshire okay everybody remembers it but they only remember it was a swap for the dump for so on the road so i don't remember it quite like that so i remember it and i was up in the road since 96 so i remember it as if we would plow that section they would give us a sticker they would give the residence a sticker i don't remember it being dumped sticker being in the whole sandwich beach overloaded is nonsense it's just nonsense i have a house 500 feet from that beach so i don't know what they're doing i don't know what i don't know what it is but you know so but you know we have as a town plow that road for 30-something years 35 years so i mean it's a for the sandwich to plow that road just set 500 feet i mean in those 35 years they weren't spent 6070 80 000 right easily so it was always my when when i took this role and i asked my and i asked my brother about because he was the road agent before i was and then asked my father but he's doesn't he's he's all the way and doesn't remember it and uh you know it was never i never got like look we could use a solid waste facility was there i would plow it and they'd give us a sticker so for 35 years they suppressed and gave us a sticker and didn't really nitpick about it just in the last few years they got the sticker or said it was only valuable for the solid waste which to me it's like solid waste is the only thing that costs you money parking vehicles same speech for two hours doesn't do anything but whatever that makes too much sense but anyway you know so i don't know maybe the minutes say that but i as a road agent in this capacity never heard that i always heard that we got a sticker and that's why i did that so i poured through the minutes the old books from the 90s the book from 1991 is on the table i bumped by every mention of this deal and if you look at it it says transfer station but it was never relayed to me that all the information i could get second hand okay because i wasn't around back then was it was for the dump sticker yeah see i never that was never relayed to me no bore that that i can remember every ounce of documentation that we can find would be uh quite just interject something from the peanut gallery and i was not present these discussions and thanks to this explanation my name is tom lee by the way that was excellent i really really appreciate that i feel the way informed now i really appreciate their comments um plainly sandwich itself interpreted it is just a sticker exactly the way you say it and we've been getting these stickers forever since the steel and the dump was called out for the precise reason several what you've said namely is the cost factor it's what does in the current expense for the time of sandwich no one was ever concerned with the 22 people who houses up the road seasonally we're going to the bobbles each you know five times a year we've overloading the parking lot this is a back-going effort to cut off rights because they have some be in their on it's nothing more or less than that it doesn't too in all towns select boards change with elections attitudes change ideas change personal agendas change and who knows what's going on over there right now i don't know you said it's going like it changed over the years and they have well that was one of the complaints that i think we had at one of the complaints that i think we had at one of our meetings out at the chapel was uh potholes but we we we we we left that meeting that people out at want to answer have to communicate with us so we can get the word road buttholes now yeah yeah you know you know you know we could get to the road agent to you know to get them fixed let me fix something you don't know me did i want to keep this as orderly as they can um jim did do you have something you want to no because i'm i'm pretty new with this i've been living all the all my life but as far as this topic i only know the history that we've read that i've read um i guess i look at it as sandwiches being petty for whatever reason it years so in i've dealt with countless issues on that road for years and so they put no value that's kind of what pisses me off is there there's no value in it and they just uh whatever there's albany albany poorly so at least bare minimum as a someone that's dealt with us a lot i think we should rather let's saying that because i get the phone calls and all that but that's the easy way out because there's no right to know there's no nothing it's not in front of the it's not in front of the camera it's not in front of anything and it doesn't establish someone's position on something so if they're going to say okay albany you paid you spent the last 35 years plowing this road and maintaining it and plowing to the end like you agreed we've given you a sticker the whole time post-covid because yeah samuiche was a little busy during covid because everybody came north but whatever and we had the same problem on firm cropper road we was parking along the road to go to the hiking trails we had to deal with that i got that put signs up and deal with the sheriff's department and we had to deal we had that everywhere you know but we've done all that for 35 years so it's just wrong i don't care what the you know we can find in the minutes we can do it it's just they have given us a sticker and we honored the thing and then they changed it after the fact based on whatever literature they could find so legally they would go what they find and legally we from what we found we don't have a leg to stand on as far as fighting so i guess my question would be for you guys who came in here what's what you see as a solution what's your end goal what's your game thank you so just for the record uh tom rough and he spoke and thank you for uh doing all research on it um i would uh just kind of start by begging you all for all that versus you guys something in the terms of reaching out and um i think that at weekend we were so on time we had an extended discussion about the history of what the secession movement and was around at the time that the real was reached and that as was i a young doctor after diagnosed but going back the answer is it was always a There was no, you know, hat sticker, park sticker, it was a stick. That was what the deal was what we all understood it to be. That would, we all got to go to the models, and we got the document for 30-something years, of course, of how we were related to each other, just wore out, but you understand. Someone now is in which wants to act like they're right clever and, you know, kept the sticker, you know, kept the sticker, the corner off the sticker and you interpret it. I don't think that, you know, we've been talking about this, like, you know, from a legal perspective, and what the down to do and all that. But the bottom of my is, is that that's not going to solve any problems, and it's going to just kind of kind of kind of kind of kind of kind of creating more on the side shelf when ideally, I think, I think, I think that would be, you know, the town to help out the people that our front of town that is stranded 25 miles away from the town. And so rather than bringing their hands too much about it, one thing that I would suggest that would be, at least something to think about, would be approaching Camar. Um, actually, I've already reached out to, I don't know, whether the team of the selection, to entering into, and so that we could be able to, like, the agreement that would have at least some values or ordinance that would have, at least some values that it doesn't give us to one way, but it's not a question. In that conversation, we, Albany has a value to the agreement that stand, I would assume as far as far as far as we, we, reason we made that agreement is plowing burn crop and the turnaround and all that. Yeah, I mean, it's not quite a turnaround, but it's just kind of we turn around, it's kind of, we turn around, it's kind of, we turn around work again. So, I mean, if we would pull out of that agreement, does that affect our, or? Well, then theoretically, it's kind of a funky road. So the first section of furne crop is Tamworth, as soon as you kind of get to the bridge, it's Albany, and then you get your right up to, right after the road to go. go to the trailhead, it's, it's, it's sandwich. So theoretically, you could stop there. So theoretically you could stop there and then sandwich would have to come out and plow. Right. Sandwich is the closest road to there. It costs them. It would be annoying. My question was, do we stick with this agreement and do you use sandwiches transfer station? And we kind of deal with Tamworth as far as beach rights? And I, I think, I think that all options are enabled. I think it may be more convenient just to put the kind of big sandwich and just going with Tamer. Let me. My only follow is the road. That was one of the reason. I'm sure we could switch. I'm sure there could maybe or possibly be a discussion with Damark about the first section. Okay. In exchange, you know. Well, that's what I was going to do. How could we do this without getting it in the budget? Is where I'm going with it. If that would be ideal, if we could get the same type of debt. Believe me, I would love to, we were going to play hardball and who needs it more. And it seems like sandwiched and us needed about the same. But if we can get Tamworth involved, I'd love the cut of home. I think it could be a . I didn't realize that section of road that Tamrith might come into play. Well, the chapel that we used to meet at is an actual Tamer. Yeah. Am I correct? They have been very sensitive towards us in this. You know, there's it. It may just be something that you could just do an even swap or if there's some money instead they're going into the budget and you're doing that maybe. There's, I remember back going to get my dad going and you buy a Sandburg sticker and you buy a sandwich sticker and it was like a complete piece and that was just what he did. Yeah. So we've got to be some way that, at least for the current top of presentation. Something could be worked out and that's all that's all we're really here. we're really here to do is to see if you guys to help us. We want to. And where our hands get tied is we can't spend the whole town's money to buy beach rights for a crime. We just, they won't. Honestly, that would have to go to a town meeting for everyone to vote on it. I don't see it past them. So if we can get a tip-for-tap swap, it's the ideal situation. If it doesn't cost them. the town money, it's awash, and everybody's good. We're frugal. Oh, we're frugal with your money, your pay taxes, too. Everyone isn't going to benefit from it, except for you guys, which, as much as I like the idea, I just as the town thing. Yeah, I think the concept is the important thing of trying to want something out in terms of the money, I don't speak for all. and the president, but I think ideally, you just swap, that's great, but there's some money that you have to be paid by to tell with people for that sector, you know, on top of the swap. There's rule for negotiation. Right. I mean, I don't, we're not coming here asking the money, but we're coming here as in for years and support. Oh, you have it. And where would there be tried to be? Would it be on Chikora? I'm sorry? It will be on Chikoro Lake. Well, there's already public access on Chikoro. There is a typical public as well. But it's no different than the public access. So there is another, because it's really not worth to get beach rights when there's a private public beach rights next door. We're not gaining much. There is. Yeah. Yeah. It's not really. And without getting too complicated, obviously, we don't want to cut off what limited rights we have and, you know, while the coyote, basically off the cliff. So it may be a situation where we preserve the sandwich dump access and you end up getting if Tamworth is not willing to conquer anything. After all, they're pretty close. It's easier for Tamwold. That's actually confirmed from that is for Sandwich. Yeah. It's a state road. Well, the state plows. It's 18. It's a pain for them too. Maybe not as big of pain. Yeah, I haven't. I mean, the Rob, they, Tamarth used to plow for a crowd 10 years ago. So when John Roberts is a road, Richard's, I mean, I don't know. I mean, that's, there's a lot of, there's some discussions. Before we even go down that road, there's some discussions. Yeah, obviously. It's a little bit of, it's a little bit too. It's a little bit too. Yeah. Yeah. I'm only, I defer to all of you, I refer to all of you who are the experts on bigger. I'm only saying, I want to elaborate with Tom Rao was saying at the end. No one wants to affect the ultimate budget and no one wants disparate treatment and benefits other people are getting. So backstopping this is that if you can even achieve, you can achieve an option of Tamworth, where there is a payment and move taxes and people can pay for the permit and done rights. done rights. People can opt into that or not. There's the fallback of Sandwich, which is an existing agreement. And if you're paying X dollars to have the TAMBOR's access, that's potentially fine to people. There's a lot of different ways to extend the gap. We're just coming as you and your help and the information with the table. You can understand to reach out to the table and have a description to. Go ahead. I'd make a suggestion that we send an official letter to sandwich selectmen from this board requesting. I think we did, didn't we? We did not. No, you went over yourself to do it. I'm saying from this board to meet directly with their board and give them the last option to bail on it. And then do the same thing with Tamworth. Let's get our backup in place. kind of first because they may say, all right, but we're not going to do anything. We're all done. And then you don't have a number. Once word gets out that we're talking with Camworth, they could be shut off right away. They could watch this tonight. We could be shut off, so not that they're going. You know what I mean? I'd hate to see that. Yes, too. Okay? Because that'll affect the whole group of people that are in Ferncroft. Well, I mean, you might, this might be the agreement, even the modified one that they're modified one that they have might be the best agreement you go out. Correct. So you might, there's a little bit of homework needs to be done for you. I would think for anybody who makes any. That's just as a citizen, not the road agent. You know, because I think this, because I mean, number one, I got to see it, just off the top of my mind, I mean, I think it's pretty similar cost structure for the tenant Albany to plot the first section on the back side of that. Right, right. To stand more interested in that. They might be like, no, we got to do this and this so we're down anyway. It really doesn't do us anything. That section is rougher, you know. So, you know, it's a little bit to that, but, you know, there's a lot of questions to be answered before that even could. And I would highly suggest that whatever we do, we get at least an MOU. Well, that's common now. It's not. You know, but, I mean, you know, what's our first move? You know, should we make an official request? If they send it back and said, we're not interested in talking to you, then let's move on. And if they... You know, I'm just afraid... I'd be just afraid that if you started going to Tamworth to talk and they found out about it, is it going to affect you? We have no written agreement. Yeah, I don't know. Personally, since there's no written agreement, all this is just going to all of this is just kind of a good faith. It is. It is. It is. It is. So, if you're going to be so petty, and it's the cut-out part because they hear that people are trying to positive. I don't want to say anything on the record, but I'd be possible. Tamworth is very protective over the pond, so they've been. on, so they're going to make sure they're willing to let more people there too. Yeah. Especially... Yeah. Yeah. I feel before we burn a bridge, we should see if we have an option, and at least put a failure out there to see if Tamworth is an option. And if it's not an option, we're going to play nice. But before I got back to Leanne and said, yeah, this is something, in some area at the town where you want to take up one that comes to the town and get you for some point in front. Well, I think we've got to put our feelings on a little bit. I think probably Richard would be a good guy to see if the road's an option, regardless of you think. Before we go to the top and to meet with this electmen, I'd like to have what we want. Yeah, you've got to get electmen down there to agree with that too. Then it's not even worth to, well, we'll still put it out there, but we'll still put it out there. we won't have an argument or a plan. So it's going to take a little bit. But I think it's important for the board to know that, I mean, we have spent tens of thousands of dollars honoring that agreement over many years, and then they've changed the agreement. But I mean, we spend a couple thousand, I mean, they would spend a couple thousand dollars a year bare minimum firing that section in sandwich. So if we've done it 35 years, $70,000. Okay. That's why, to me, this is all just crazy. It's like, by I would just like on a sandwich, I would never even be a concern. This wouldn't even be a thought of mine. I mean, but sandwich is sandwich. Yep. Yeah, so it's a tax, you know, it's a very highly taxed town. town. So in Albany's a very low time. I think we kind of do things a little bit more streamlined to where the little town we are. But that being said, I still feel like they're not honored. And I do, like I said, I'm in that area, sometimes quite a bit, and I kind of don't understand the concern. So that us don't see it. So I don't know what the deal is. it is here, but we have spent tens of thousands of dollars on our agreement. This is why I suggest we start with a beating face-to-face, select board to select board. I'd send them a letter certified to get assigned for it. And we expect an answer back, give them a deadline for an answer. And every year we go and we plow that road, and every year, the residents of that road, get a sticker. So every year that happens, every year we go to town, we vote, and, and in the residents of that road, and vote on our operating budget, and there's parts of that in operating budget that are based on those agreements. I don't care if they're on the back of my tailgate. It's still an agreement. Yep. And they know it. So at least on the town side, I want them to say they no longer are providing by that agreement. I want to hear that face. I want to hear it. So then we can make decisions going forward. going forward on the road I would invite them to a meeting either here or we'll go over there. I'm not going to come here. We'll go there. No big deal. Oh yeah, make them answer it. We need to seriously talk about this situation. Because like I said, I don't remember it just being transfer station. I know that's what you guys saying. I'm going on what people are telling me. I was just, like you said, it was just a sticker. No, when I spoke with their town administrator, she said the reason they were doing it is because they had a problem with Airbnb. And I asked why not curb the Airbnb, and she said they were starting with Lancet. Yeah. Well, the state has gotten, let that get out of control. I mean, they have definitely changed their parameters with what they do. I mean, they give you a little blue sticker, it's blue this year, whatever, and the last few is blue. But they used to give you a guest pass. pass with if you're a landowner and sandwich they give you the blue stickers for your vehicles and they give you a guest pass where they've changed the gas pass so you can't use the boat ramp now you use the beat you can't use the boat so they've definitely been changing it to try to address some of these issues so that yes the Airbnb people can't take a guest pass on the counter and go put their boat in they've made those changes but never once how many guest passes are a you allow? Not 22. Or I was going to say, we can buy a piece of land over there and get guest passes for everybody. But that's what I would suggest. And if we hit a head wall there? I don't want to walk in there and then say, too bad, so sad and we're standing there with our head and our head and our hands walking out like we lost, I'd rather say, oh, well, we're going to go to plan B. we're going to go to plan B. So I'd like a little bit of information on plan B before we cower down. I don't think we're going to go in there and scream where right and they can scream they're right. And at the end of the meeting, we walk out and very upset. But when I walk out upset, I'll say, okay, we're going to go plan B. So let's ask a few questions at least. And then we'll set up that meeting. It's going to take a while to get us in if they get us in at all. So we'll get that. that are going. And meanwhile, I get a couple people I can call in Tamler and see what, you know, if they say no, there's nothing we can do for you. I'm not one for beating around the bush. Let's go face to face. Yeah, no. Neither am I. We go face to face and we lose. I'm not easily intimidated. They may say, well, we don't want the plan anymore. That's, but that's what I'd like to hear. And we'll look for alternative. Because there's no agreement. So. Let's do it right. And we could put it, well, no. You don't have to have a contract, have an agreement. No. Oh, I know. So, you know. They've acknowledged this exists. It's just what the meat of it is. They moved the goalbook. The question that was there, or one person that was there, and one person that was present at the time and fully understood what was going to be appreciated. Yeah. So I'm going to pave the steep parts of Bald Hill where we've had constant problems over the last 20 years. And I'm remiss it myself that I haven't done it yet. But I always catch some heat for paving ditches because people don't like how it looks. But, you know, I also don't want to. But they don't like how it looks when it gets washed out. Right, exactly. So we're going to do that, and I'm going to finish that in the next three weeks. Also, we have the section on Drake Hill Road. We have the section on Drake Hill Road that was the storm damage, and we're going to pave that section, that Southern Hill on Drake Hill Road where we had all that damage. We're going to pave that shortly. What did you do on Old Colony Road? So when we do that, we do that, we're going to move to a colony row. We're going to change the culvert out to a bigger side to try to get that rock, push back a little bit best we can without spending a fortune on it. We're going to create a drainage swale on the other side to try to stop massive amounts of water hurting the homeowner's house or maybe redirect it like we looked at. So that we're going to do that. And then I'm going to run out to pass the Conway. if I have some money left over, after we get all this paving done, to go out and to help skim some of the, just to shim some of the rough sections of Passa Conway. Also, when I was out on Passa Conway, the covered bridge, I fixed some boards on the covered bridge, and the cover bridge needs to be painted. So I was going to, with normal highway budget funds, I was going to paint the whole, interior of cover bridge put on the put on a paint that's a fire retardant paint and then I would like to stain the covered bridge that's going to have to be something that we're going to have to have mother nature help us a little bit because it's going to be very hard to stain it when the leaves are beautiful which that we're basically almost there getting there unfortunately so I want to try to staying the outside of the covered bridge after the leaves are gone, weather permitting, because it's really dry. So we got to do it. The roof's good. I did check the bridge. We got an email or something on some. I didn't see any structural. I'm not an engineer. So, no, but I didn't see anything that was like, I was looking at like I thought was dangerous on the covered bridge. So, but it does. Is there any state money? What's that? Is there any state money available for? So the state replant and structurally fixed that bridge years ago. I don't know. I don't know 10 years ago. So they did that. I don't know of any money, but I don't think staining it. I think we, that's total in-house stuff. We can handle that. I reached out to the Forest Service to try to see if they, on Pass, regarding Paso County, we saw the Forest Service to see if they would partake in helping with some of all their trees on their property. that are dead from the caterpillars a couple of three years ago, I haven't gotten any response, which is no shot. It's not shocking at all. The Forest Service. God bless them, they all work really hard, but they don't have money either, right? So they don't really want to be cutting trees. But we are going to have to cut some trees. My approach to that is we're going to cut some trees and, you know, and we're going to leave them on the ground. I make great habitat. Environmental should love it. But we're going to have to deal with it. one way or the other because it's a real problem. But, and I don't think we're going to get any help for us. The suggestion was that first thing, first off, the people would have to come and get approval from the slide then. And then once they did, if you guys wanted to approve it, they do the work, the health inspector would have to sign off on it before it would be not condemned. So that is the update on that. I would make a motion to put a letter together, letting that co-op know what has to be done exactly to bring that up to health standards and send it certified mail and it has to be approved by either our health officer or the state health department that it's a livable structure and healthy I'll second that for conversations.
