The Excavations Subcommittee met September 11, 2026, with members Marshall Golberg, Stephen Berry, and Mark Lofgren present. Steve Berry agreed to revise the draft gravel pit inspection form to include yes/no answers, lot boundary visibility checks, and invasive species inquiries, presenting it to the full Planning Board later. Task Force of the Planning Board to Review and Propose Updates to
the Earth Excavation and Restoration Regulations

September 11, 2026

Meeting called to order at 8:00 am
The meeting was called to order by Marshall Goldberg at 8:00 am. Stephen Berry, Chris Kinville, and Mark
Lofgren were also present. No members of the public attended.
The task force members discussed the draft of the gravel pit inspection form that had been prepared by Steve
Berry. Steve agreed to make additional edits to the draft inspection form, including to reflect “yes or no”
answers to each question, to note if lot boundaries are evident, and to inquire as to the presence of any
invasive species, and to present the updated form to the full Planning Board for review.
The task force then reviewed the existing Earth Excavation and Restoration Regulations (the “Regulations”).
Mark Lofgren walked through an analysis from an AI program which compared the existing regulations to the
current State regulations in RSA 155-E, which identified only minor possible updates The task force then
reviewed the entire Regulations. The task force identified a number of mostly minor changes to propose. The
proposed changes recommended for consideration are shown in the attached document (proposed deletions
are designated with stricken text, and additions are designated with underlined text).
The task force also discussed the status of the two active gravel pits in town and noted that each pit had filed
reports in 1991 that qualified the pits for grandfathered treatment under RSA 155-E:2.1(d). Provided those
pits are not abandoned and otherwise continue to operate in accordance with applicable requirements of RSA
155-E and the Brookfield Earth Excavation and Restoration Regulations, the task force noted that they would
not need further permits from the town.
Mark Lofgren agreed to draft minutes of the meeting and to draft revisions to the Regulations to reflect the
task forces’ proposed changes.
The meeting was adjourned at 9:20 am.
