Board of Commissioners Meeting
The Board of Commissioners unanimously approved signing the Inter-Municipal Agreement (IMA) for wastewater disposal with Conway, contingent upon Department of Justice approval. Commissioner Fauver moved, seconded by Commissioner Morrison, passing 3-0-0 to settle the Conway Village Fire District lawsuit by signing a mutual general release and terminating the court case. Regarding PFAS treatment, Commissioners discussed wastewater sludge disposal and agreed maintaining local control and utilizing current funding opportunities is preferable to future full project funding. Superintendent Gagnon and Mr. Smith will continue investigating building a shared PFAS treatment facility and associated costs. The meeting adjourned at 5:06 PM. Commission Meeting 07/14/2026 Adopted: 08/17/2026 Page | 1 Board of Commissioners Public Minutes July 14, 2026 The Commission meeting convened at 4:00 PM at Conway Town Hall. The following were present: Commissioner James Umberger Commissioner Deborah Fauver Commissioner Rodney Morrison Superintendent Jason Gagnon CALL TO ORDER The meeting was called to order at 4:05 PM by Commissioner Umberger. SIGNING OF IMA WASTEWATER DISPOSAL AGREEMENT Andrew Smith appeared with Superintendent of the NCWP Jason Gagnon and NCWP Commissioners, Jim Umberger, Deborah Fauver and Rodney Morrison. Mr. Smith explained that they had been working hard on a new IMA between Conway and NCWP and the final draft was just waiting for Department of Justice review. Mr. Smith and Mr. Gagnon expressed their feelings that this new IMA makes billing less complicated and clears up the language from the old IMA. Mr. Smith noted that there had been a lawsuit between CVFD and NCWP, but they believe that the updates to the IMA solve the issues. Mr. Umberger opened the Board of Commissioners meeting at 4:05 pm. Mr. Thibodeau stated that he believed they had all done a tremendous job and that this was good for both parties. Mr. Thibodeau moved, seconded by Mr. Shepard, to sign the IMA as presented conditional upon Department of Justice Approval. The motion carried unanimously. Steve Bamsey, former CVFD asked what the benefits of this were for the residents in Conway Village. Mr. Smith stated that he believed that the new IMA was transparent and fair. Mr. Bamsey asked what the protections for the people in the town were. Mr. Smith stated that the IMA gave the transparency as well as the ability to give input prior to capital expenses. Mr. Thibodeau also added that it was a long-term agreement that gives rate payers stability. Bill Hounsell commended the group for coming together to protect the drinking water. Motion of Commissioner Fauver to sign the IMA as presented conditional upon Department of Justice Approval. Second by Commissioner Morrison. Motion carried by a 3-0-0 voice vote. Mr. Thibodeau moved, seconded by Mr. Porter, that if the North Conway Water Precinct is in agreement, the Town and the Precinct will sign a mutual general release of all claims related to the case Commission Meeting 07/14/2026 Adopted: 08/17/2026 Page | 2 that originated as the Conway Village Fire District vs. North Conway Water Precinct pending in Carroll County Superior Court. The motion carried unanimously. Mr. Thibodeau moved, seconded by Mr. Porter, to instruct the Town’s attorney to file the appropriate paperwork with the Court to terminate the pending case. The motion carried unanimously. Motion of Commissioner Fauver, that if the Town of Conway is in agreement, the Town and North Conway Water Precinct sign a mutual general release of all claims related to the case that originated as the Conway Village Fire District vs. North Conway Water Precinct pending in Carroll County Superior Court. And also, that the North Conway Water Precinct instruct the Precinct attorney to file the appropriate paperwork with the Court to terminate the pending case. Second by Commissioner Morrison. Motion carried by a 3-0-0 voice vote. DISCUSSION OF PFAS TREATMENT AND LANDFILL Mr. Smith introduced members of the Lower MWV Solid Waste Committee, Rick Hiland and Amy Snow. Mr. Gagnon reviewed the issues with PFAS and the Town. He explained that they have been looking into options for wastewater sludge disposal. He reviewed an analysis he had created. (See attached). After much discussion, the consensus between both the Board of Selectmen and the Commissioners was the importance of keeping local control and utilizing funding opportunities now instead of having to fund a full project in the future. Mr. Smith stated that he and Jason Gagnon will continue looking into building a PFAS treatment facility and what those shared costs would look like. The Commissioners closed their meeting at 5:06 pm. ADJOURN Having nothing further to come before this public meeting, motioned by Commissioner Fauver to adjourn at 5:06PM. Second by Commissioner Morrison. Motion carried by a 3-0-0 voice vote.
