The Planning Board approved a subdivision for 74 River Road owned by John and Joe Ritchie. The vote was unanimous. The Zoning Board had previously granted a variance. Five conditions were imposed, including a certificate of monumentation, PDF and mylar plans, two years for approval to expire, and title correction. The Board then discussed a site plan amendment for Subcom LLC for a pan building, chiller building, and parking lot. A public hearing was not held, and the application was not accepted as complete due to inconsistent reviews and incomplete drainage plans. He often proposed a subdivide 5.7-acre watt
with the road fundage on River Road and the Shaddaquay.
Subject parcel was located in the industrial,
the only district, his only road.
adjustment, granted a variance 5.13.26 on 13 of May, excuse me, to allow us in the
creation of a 1.11-acre lot where 4.6 acres were required. All right. So they got their

We're here tonight for a subdivision approval.
We went before the ZBA in May and were unanimously granted a variance for a 1.1-1-acre lot where
200,000 square feet required. So we're here tonight seeking the board's approval
for this subdivision plan. So if there's any questions, are you glad to answer them?

of the ZBA? There was only, there was only one condition and that is... They had any.

line right here was twisted a little bit that way. So this, this culvert and this
cover were on two different lots, and the ZBA said, let's put them all on the small lot.
So that makes sense. That's what we did. As long as they wanted, obviously, they weren't
granting a variance for a big lot, so the big lot had to remain 200,000 square feet, which it did.
So now both drain structures are on the small lot, which I think makes sense.

There's a couple of permits that we need to get slash amend.
That's why, one of them in which is why I've heard before you today.
That is the site plan slash site plan amend.
of the previous application that you approved back in December.
The other one is a federal permit, which is the general construction permit.
We will be amending that after this approval.
We also are seeking two waivers.
Those waivers you granted before, they are slightly modified based off of the changes to the site plan,
that being from Section 18A for parking spaces and Section 16G for bonding.
Some other permits that were brought up in the third part
in the review by the third party engineer were a conditional use permit for the
widening of the access drive into the site.
That widening would have occurred within the wetland setback, which would have been
additional payment, which through conversations with the reviewer, would require a
additional use permit.
We really do not want to hold up this approval, so we would withdraw that portion of the site
plan that's before you to not need that conditional use permit.
So if we can get to a approval here tonight, we would accept the condition to strike the improvements on sheet SP-3c from the application.
Additionally, the third-party reviewer raised concerns of whether an alteration of terrain permit is required.
However, we are very minimally below the 100,000 square foot threshold for that permit.
However, the site has been designed to accommodate.
to accommodate for an alteration of terrain permit in the future due to any future expansions
will trigger that permit and we, and so the stormwater has been designed in performance with those
permits. Can I go back to SP3C? Yes. I'm on looking at, would you please explain what you're
proposing on not doing? Yep. Yep. Yeah, perfect. So do you see that area shaded in gray there?
We were originally hopeful to include this as part of this site plan amendment
for some extra queuing length for, I believe it's visiting vehicles as they get through the guard gate.
If you see the line, the dash line that's directly below it, that kind of has an art to it,
that is the offset of Hallbrook.
And to have impervious area within that offset, you need to apply.
for a conditional use permit for the driveway. So it's either would have been a variance or a
conditional use permit. The third-party reviewer recommended it it would be a conditional use permit. However,
we really need to receive approval here tonight so that we can keep the construction going on
because it is an ongoing construction site. And with these additions, we'd like to wrap those
up as quick as possible. Can I make a suggestion to you? Sure. I went through these plants.

I don't take offense to that because I'm filling it in for Doug Brador, so we'll pass it on to them.
I would like to simplify it, really bring it down, and go right to A-09,
which, and tell us what you're going to be doing and why you're doing that.

The architecture line, AO-9, architectural. And the reason why I want to do that, I want to familiarize everybody with the board, with what they're doing.
and what you're trying to do, because what I was really thinking about doing before we,
I know you said you want to pull with tonight, I was wanting to do a site plan on your site walk
to see what, see what you're doing out there. So we get familiar. There's a lot of stuff
going on out there. I also want to, I don't know, Sam, if you've been talking to Doug, but
it was brought to our attention that Doug, Doug, Doug, actually pulled back our review of this project
because he said he has to redesign the drainage system. So I'm not even sure that's something we'll have to talk about.
want to accept this application as complete. I'm fine what you're doing because they've submitted
a drainage plan, but it's going to be amended and dug directed error to not review it because
of that. So there's no, this thing is no way, we're not going to get approved. So I think,
I think the reason that that came up is because they were thinking about a future project and changing
the large retention pond, which we advise them, if that's the case, you should probably
do it when you do your future building. Let's not go through the brighameral of permitting some kind of system that will never be used. We have to get our inspections and sign off for the extrusion building and the panachiller. So that's what we recommended to Dove is to keep the drainage plan as shown.
So let's say something else. The problem is that we were given instructions to stop. Yeah, I can't. I can't. I can't. So if that's the case, we can't give an approval.

understood. I don't know why Doug would have done that. I mean, Eric, we had the conversation.
Eric and I met with Doug, and that's what the conversation, that was the conversation we had with him before he left.

And he said, no, that has nothing to do with the chamber system. I said, because if it does, let's bring that down the road.

the parking. The issue is he couldn't even, he didn't even spend any more time on what you were
proposing to do. He didn't just saying we're just going to do justice. Yeah, understood. Is that what I said

drainage was changing, there was other aspects that would probably be going to change as much.

Yeah, I recognize that puts it in a weird scenario where this is a very, I don't really like the term fluid, but it kind of is a fluid project where there's an existing approval right now.
They're actively working on the site. There's this amendment to that site plan because
because they've, I think they've had more orders than they've expected.
And that's where the pan building was needed.
And then it was basically said, well, if we're going to do the pan building,
we might as we'd do the chiller building. And if we're going to do those two buildings,
we might as we do the parking lot. And then it gets into, well, how do we future-proof this
and make sure it's ready to go for the future on the next expansion?
And then I think that's where Doug might have had the conversations about pulled off on the full stormwater
design because he wanted to double check to make sure that that portion over there
is not going to impede the future. Well, this is a full plan set and full drainage analysis
that, in my mind, could be approved today. I recognize that the Eric had never got a chance
to approve it, and I think him probably... Well, you don't approve anything.
Well, I'm sure, like most third-party review engineers, you know, I'm sure like most third-party review
engineers, you're valued here in town and your input is aimed on heavily for the technical
side of things. And I'm sure Doug viewed telling you to stop, telling the review on the drainage
to stop was this board trusts Eric to review the technical side of the thing. If he gives
the thumbs up and is conditioned on something like that where I think the last approval even
has something similar to that. At a later date, that's how this could get approved, where it could get
approved where there's a satisfactory letter from the town's third party of review engineer.
And that's basically what Doug thought would happen and his email response. It would just be
an approval with a list, kind of like, you know, a conditional approval to meet these standards.
Like on the last round, we had the cable landscape long. So I think in his mind that's what he was
thinking. Yeah, like, so like I looked at the original condition of approval and if we got to this point
tonight I was going to basically say we can pretty much do all the same conditions
of approval of the first one I'm going to be correct technical issues identified
Altus engineering and the new 18 planning department for final project review
that I just I want to make a comment because this has been a frustration of mine and
when we started talking to Doug about this project and I want to say January we had several
meetings set up that were canceled and I said to Doug we can't go
through what we went through last time. Because the last time it was, there was a gun to my head,
we got to get this approval. We're not going through that again. He said, no problem. We don't
have the pressure on us. Now here we are tonight, the very first meeting and you ask me for
an approval. So it's, it's, you know, I just, you know, you got to do better because this is not,
it can't, it can't, it can't, and we, we, we had extensive conditions to help you out. Sure.
But every, you know, it's every time it's an emergency, you know. Yeah. And I can't, and I can't,
I remember one of the very first projects I got involved with that subcom.
There was an emergency for 140,000 square foot building. We approved it and never got built.
Yeah, so it's hard to share it. So let's get beyond approval tonight. It's not going to happen.

a large project. What you're proposing and doing. I wouldn't expect it typically to go one meeting
anyways because of the complexity of it. I would expect it to go to. That's typically what we have seen.

and then the chiller building, which is this weird little box. The pan building below is similar to subcom. It's basically open with a axis walkway and a production level on this level.

tanks that go out 30, 40 feet. That would have been in that expansion that they didn't do.
The pans are the big, huge, um, mobile, mobile cans that they moved. And they got some pretty

sidewalk, we think it's possible, we think so. Absolutely. I've seen it. It's really, it's pretty cool. It's
really cool. It's really cool. I really amazed by the guy. I just standing there all day long.
Can you spin one of the other angles? Because one of the things that I notice, but it doesn't really come obvious on the site plan is that inside the loading dock area, the building is actually a cantilevered, and not a lower level.

He'll use the site in with no support. Yes. You get to that. And when we get to that, it's
highlighted green to show the footprint of the building. But for him, he's saying it's not very clear.
When I saw a green manhole and the vehicle, why? And then parking. So that's what we're trying to
propose tonight is this building, the chiller building addition and the Pan Station addition.
which have both already gone through life safety reviews. And I think we have a pretty complete set.
And the parking, your parking is calculated of the number of new employees that this is going to generate.
Yeah, which I believe it was 14. 14. I think they add.
I think there's 14 for the, the extrusion building and then 14 for the chiller building, or the pan and the chiller building.
Yeah, so the extrusion was already,
permanent. That was part of December. So the two new buildings will have 14 more.
So I wanted to bring this up to show just a big picture where they'll look like. I think it makes a lot of sense because I was trying to make a lot of sense of the first pages and I finally figured it out and I got to all I got to the last page to show the architectural rendering that you're trying to do. Yeah, really good. Yeah. I think they did a good job.
You can see the retention. They did. I mean, I was able to
followed with but they just took some time yeah so John did ask some questions about
employees and the shifts the number of number of employees the shifts and then parking I'm trying
to tie all those things together so I know that you know a lot of space with few
people in them and that's because these pan, I forgot what you call, pan storage facilities
are huge and it's just one of two people in it at any one time probably yeah it's only 14
How was the parking right now?
Oh, it's plenty of parking.
I just want to, well, I just want to make sure there's plenty of parking.

And so there's no problem with parking. Seven days a week.

any vehicles in it. Everyone tries

to get this parking lot done.

So in the storm drain, I know if I'll be
talking about it, but it looks like some of the
storm drains go into the building
or suck and originate
in the building and then come out and then
dunk into a wetland.

you would be required to have 1,325 parking spaces. Currently with the addition, they
would have 907 employees. And then I give in, on the first shift, there's approximately 500
employees, which there's, with this proposal, there'd be 665 parking spaces, which is about 25% more
than what their actual needs are.
So with that, we'd be seeking the waiver for a to welfare reduction in required parking spaces
down to what we have proposed on the plan, which is 665 spaces.
Additionally, like the last time, for Section 16.G for bonding, subcom has been in town for a while.
they're committed to finishing their projects and to bond a project of the scale is costly and
they're committed to getting it done. So we'd like to receive approval for both of those
labors. Again, we can address them tonight or...

It just puts, it puts, it puts, it puts, it puts, it puts, it was a hard burn with it in that manner,
because you're, often, you are trying to finish at the same time that, you're trying to get a CO,
and that the surveyor has to go out.
after everything's all done and then survey it and so you're sitting there with a complete
building and you can't get a CO because the survey's not done so I've felt that
pressure before so I don't want that that that's not totally yeah I just don't want it
in that manner what we there was a bond with the hotel and I think there was a
condition the approval was either 30 or 60 days
after a CO that the ASBEL was complete, but we had a bond in place.
So I just don't want to see the survey crew scrambling and then I look at it and say,
well, that doesn't look right and then everyone's screaming at me saying, I need a CO.
I guess I can appreciate that.
I mean, this could be, especially because I've been on the other side of that, of get our
service crews out there. And then when you have to inform the client that an
Inver is all messed up, it's not a fun conversation. With that, I guess you could condition
it either way where it's up to them if they're going to hold up their CO because there might be an error
in the site design and then that's obviously on us. Or if they don't want to hold it up because
of the as-built conditions, they could put up a bomb for the stormwater. I don't know if there's a way
that words get that what would the bond be on this if the way the regulations
call out John you know what's a what I don't know what is a percentage I don't know what
is it a is it a hundred percent of the site what's not only a hundred percent
percent so maybe there's a scenario I'm talking about the rest of the project

could find a way to reduce that as you go as the work is done but we have some money

reduced bonds but I've never seen it totally gone and I think it's not a good
idea to be totally gone and then we do it before the CEO is done we've had a lot
trouble recently even in the past where people come in they want
things done approved because of the conditions that they still have to meet but
they're not around getting it done and they don't and what keeps them moving is that
fine it's the basically at the time when you get the building all built the only
hammer we have at that particular point is other than is to say the CEO and we're
not going to give you the CEO until you done and then all of a sudden wait a minute
we got how many million hundred million dollar facility built
and we can't use it because of us whatever something's wrong with the storm drainage
things happen a lot quicker I guess the attention a lot quicker than when we don't so I
you're not going anywhere there's no doubt my mind you're not but at the same time I think
giving nothing it's not the way to go okay yeah I recognize that I recognize that it's
this discussion is more about making sure that subcom is all set and putting this group
the subcom like it's no good it's not the infant so I think I think the
time was shown and it's both of us have gone both ways we help each other yeah and

requirement for the bond in this case is to support subcom operating their

drainage until all the drainage improvements are done now that you may
make everything back and said you know it's just not seated properly but you know
that's minor stuff yeah could could could uh
it may be a proportion of that because theoretically we're talking at the end when
everything is built or the majority of everything so bob just mentioned and i think it's appropriate is you
bond for the all the drainage but you can have bond reductions along the way you know as as you're
25% built we come in and say hey we're 25% built we go out and check that here's a problem with that you see a
25% filled but the system only works if it's 100% and it's probably if the first 25%

little estimate you look at it and say this looks good or this item looks low
that item looks low or whatever we won't tell you that we think it's something is high by
and then it's agreed upon this is the bond they put the money into
the bond during the construction project when they feel like they've gotten
to a point where they want some money back they'll make a request they'll take
that same estimate and say percent complete mobilization 100% clearing and
growing I understand that but who decides what deduction is so
writing a letter to the board of selectmen because they are the ones who
oversee it recommending the volume reduction the board of selectmen either accepts
what I say or they don't accept the list I don't know Bob where I can give
yes I let's leave that one a way I have and again that with the what the industry
is what the typical retainages but it's not you're not going to give them a dollar or
it up you might hold ten percent back
yeah and and we'll obviously make sure that there is a certain number
left including the contingency and I would say I think it makes most sense
just to you come up with an amount and then it's a proportion of the amount and
I'll throw about 10% because I can't go I can't go down because this really only
matters when you get to the end of the project right so so we can kind of we can kind of
skip this the step of all those reductions to you get to the end and we can
just jump right to the end well that says they don't want to reduce what's that some

bond is three and a thousand dollars he's suggesting they start with 30,000 because

And then, well, there are some areas that may still look suitable for some landscaping when you
look at this plan.
You can also see that there are some temporary snow storage where if you can see adjacent
to the stormwater pond there, and it's temporarily there.
So that they can push snow during a snow event, and then they can relocate it to the more
larger temporary snow storage area that's located, I believe, at the southern side of the site
closer to the front, and then eventually that snow will be trucked off.
There's too much enough, but we believe that this landscape plan does meet the intent of the standards
outlined in Section 15, specifically 15A, with retaining some of the original landscape in
which you can see in the bottom left-hand corner of that stormwater basin, providing screen for service
structures, which is the transformer area, providing visual coverage in large paper.
areas which we try to put some landscaping between the parking lot here and then it is
kind of hard to break up the building facade given that it is it's a pretty large building
you can't see it from you exactly so most landscaping standards are meant for where the
public's going to go and where the public can see it with some being for kind of shaming a parking
less trying to keep cool it down a little bit but in this scenario I don't really see that being
that feasible but we did make our
best attempt to provide some landscaping that took reform to the standards.
And the client wants it to look nice, so they want us to get as many trees as we can in there,
and they want it, they want it to look good for their employees. So our intent is...
