The applicant is requesting permission for a variance from the fifty-foot setback, front setback to the road to construct a two-car garage on the existing non-conforming lot. Okay. good evening. we are requesting a variance from the fi- fifty foot set fo-setback requirement to allow placement of a thirty by twenty-five foot two-car garage on a thirty-one by twenty-six foot concrete slab. Due to the unique physical constraints of our property, there's no practical alternative location for the garage that fully complies with the setback. Our lot is under one half acre, the rear of the property has a steep embankment that makes construction impractical, and the water line from our well to the house crosses the driveway. In front of the garage, but now limiting placement options. The proposed location remains outside the stage's twenty-five foot right-of-way, does not obstruct sightlines for our driveway or neighboring driveways, and will not create any public safety concerns. The garage is a cus-customary residential accessory structure that will be consistent with the neighborhood and will not negatively impact surrounding properties. We believe this request is the minimum relief necessary to allow reasonable use of our property and respectfully ask the board to approve the variance. Thank you. Granting request of variance to allow construction of a thirty-one by twenty-six foot concrete slab and placement of a thirty by twenty-five foot metal garage within the setback area wouldn't be contrary to the public interest. The proposed structure will not obstruct visibility for vehicles entering or exiting either the applicant's driveway or neighboring driveways. Traffic safety and sight distance will remain unaffected. The proposed garage is residential in nature and consistent with the character of the surrounding neighborhood. If the variance were granted, the spirit of the ordinance would be observed because the spirit of the setback ordinance is to promote safe placement of structures, maintain orderly development, and protect neighboring properties. The proposed location satisfies these purposes because the garage will remain compatible with surrounding residential properties and won't create safety concerns or overcrowding. Granting the variance would therefore observe the spirit of the ordinance while allowing reasonable use of the property despite its physical limitations. Granting the variance would do sub-substantial justice because substantial just-justice would be done by granting the variance because the benefit to the applicants outweigh any potential harm to the public. The requested relief is limited in space and necessary due to the property's unique physical constraints. Denial of the variance would impose an unnecessary burden on the applicant while providing little or no corresponding benefit to the public or surrounding property owners. If the variance were granted, the values of the surrounding properties wouldn't be diminished. The proposed garage is a customary residential accessory structure that will be maintained in a manner consistent with the neighborhood. The structure will not negatively impact neighboring properties or alter the residential character of the area. The rear portion of the property contains a steep embankment that makes construction in that location impractical. In addition, the water line serving residents runs across the driveway area near the existing garage, limiting alternative placement options and creating concerns regarding future access and disturbance of utilities. The applicant is asking requesting permission for a special exception to operate a home business in the residential one district. So you may proceed with your application. Thank you. Good evening, my name is Mark Lurier, and I live at Fifteen Page Lane. Thank you for the opportunity to present my request for a special exception for a small, appointment-only home-based car detailing business. I want to begin by emphasizing that this is a low-intensity, one customer at a time operation that fully complies with requirements of Article Two, Section two o four dot three R one. As stated in my application, no more than one customer vehicle will be, will be present at a time, and all work will take place on my property using existing driveway space. There are no structural changes, no signage, no outdoor storage, and no commercial lighting proposed. I understand there may be concerns from my neighbors, for example, won't an appeal, I'm sorry, won't an approval of this request set a precedent for businesses in the neighborhood? The special exception isn't a blanket approval for anyone else, it is a case-by-case determination based on whether this specific use of this specific property meets the ordinance criteria. Granting my request doesn't automatically allow any other home business on page one. Each future applicant would still need to go through the same process and meet the same standards. Also, approving this request doesn't open the door to unrestricted commercial activity It simply recognizes that this particular use is small scale, low impact, and compatible with the R1 zone. Another concern is what happens if I sell my home, which I have no plans to do. As I understand, the special exception doesn't automatically transfer to a new owner unless the new owner operates the exact same use under the exact same conditions. In order to change use Expand, add employees, add signage, or increase traffic, they would need to come back before the board for approval. Additionally, the board has the authority to attach conditions to this approval Such as what is outlined in my request already. One customer at a time, appointment only operation, no signage, no non-resident employees, no outdoor storage. These conditions ensure that the user remains exactly as represented. Quiet, small scale, and residential in character. I believe my proposal meets the ordinance criteria in the following ways. Community facilities. This is a low intensity operation with no measurable impact on police, fire, or emergency services. Character of the area, the property will remain fully residential in appearance with no visible commercial activity. I take pride in my home's appearance and would not want to detract from it. Traffic, customer visits are limited and scheduled. Traffic levels will remain comparable to normal residential activity. Noise and nuisance: Detailing work produces no smoke, dust, or excessive noise. Cleaning products are commercially available materials stored indoors and considered environmentally safe. Property values, the use is un-unobtrusive and doesn't alter the residential nature of the neighborhood. This is a small, quiet, low impact home business that fits the intent of the ordinance and preserves the character of the neighborhood In closing, this business is designed to be totally compatible with the Arland District. I believe it meets all requirements of the ordinance and doesn't create adverse impacts. I respectfully request approval of the special exception. I've never been this type of procedural hearing before, so I-- This is my husband, Ryan Duhamel, who is also the same residence as me. I have a statement, and I also have a couple of questions, so I just wanna be respectful of how to utilize your time and how to go about asking and doing so. I think that sounds perfect. So can I just follow up with Mark's statement? So if he were to sell his property, though he said he has no, you know, intent to do that at this moment, how would, if this special agreement was allowed, how would that affect the new home buyer? No, we could, we could make a condition that the, that it doesn't go with the sale of the land, they call it. Okay. This is granted to him and to him only and not to the property. Okay. And then how would that allow for, I guess, other individuals in the neighborhood that now want to have a business, personal business, like, it, it's a little bit to me like a slippery slope? It, it is. It, it, I, I do this for a living, and I can tell you right now that home occupations are nothing new. People starting Starting Reiki or they're doing computer repair, I get probably twenty of these a week in different towns. So if you, you know, if you want to start a cupcake baking business, that's considered a home occupation. If you want to do computer programming In order to be licensed by the state in Massachusetts, I'm not sure also, but in order to get a, a business license in the state of Mass, you have to have a home occupation permit from the town, if you start it out of town. So it isn't It isn't a it isn't a wild, like no one's ever done this before. So it, it is, it is a norm, and the question is, is I, and I would agree with you that sometimes people do get out of hand Landscapers, the client grows, all of a sudden they got sixty-three trucks a-in, in forty-eight plows, and you're looking at a contractor shop. Unfortunately, my job is to go shut it down. I think she means slippery slope, like once this is approved and- 'Cause it can-- There's always gonna be a precedent, you know, and now like-- Well, I mean, it depends on what they're doing. There, there are certain outlines of home occupations that they can and cannot do. There's certain criteria that they can. So can you-- Yes. Right. So can you go in there and open up a contract to Jard and a fellow Tate's lumber? South, out of your house next door, no, you cannot. There are certain criteria you have to meet, ninety-nine percent of the time, it has to do with it can't be, it's gonna be screened, no one can see it, it can't have more parking. Basically, what, honestly, what he outlined is, is some most of the criteria for a special exception. Okay. So it really is an individual case, it's case by case. And a lot of times, if it affects a septic system, it's not granted if you don't have, you know what I mean? If you're bringing customers over and you're doing a hair care salon and you don't have the septic to do it, you can't grant it. Okay. And I did a lot of research, and I couldn't really find out why the neighborhood was originally zoned to be just residential only. Like, was there a specific reason when it was first constructed on why it was zoned that It was originally manufactured housing and when the gentleman sold it the attorney went in for a, an RA district Our, our one district zone could have gone into our A, but went into our one. So that, that's the history of that. Probably the size of the lot. Okay. So I, I do know that based upon the information you provided earlier at the beginning of the meeting that we have to have obviously three in confirmation to allow for this to proceed, but if you're saying that you're gonna attach additions and, you know, differences in how this is- Outlined, like how are we gonna be able to, as a neighborhood, review that prior to your approval, if you're approving it right now, without us being able to see that? With all due respect, you don't have approval authority. No, no, no, we're going to put the conditions on it. If there's some other condition that you think should be put on it, speak up and we'll, we have, we have pretty, we're pretty lateral on what we can do here. If there's something that you think that- You know, this-- if you have an idea, throw it out. I have, I'm not gonna think of everything, and neither is Don or neither is Nick. So if you have an idea of like, hey, I don't want this, I don't want that, and can we control this, please. Of course. Or feel free. House is pristine, very Like I cannot talk highly enough about him, very happy to be his neighbor. my issue right now is chemicals, as you know that in his application And bear with me, 'cause I have a lot of notes here. In his application, he does say the business doesn't involve hazardous materials beyond small quantities of standard consumer-grade cleaning products, all of which will be stored safely indoors. We have swale directly across the street from his residence. I'm concerned about overflow from washing and detailing cars going into the flow, which the swale, which would obviously at some point get into our well system, which we have, and we've scheduled A lot of money, two, or the river I was gonna say, yeah, and the skywalk. She's, she's a talker. And the skywalk. So those are two major issues for me. I one hundred percent believe Mark, he seems like a very trustworthy gentleman, but there hasn't been a list of materials that's been provided to you on what he's gonna be using. To ensure they are in fact EPA friendly and environmentally friendly. as much as I love this country and our government I'm gonna say that you guys, well, not you guys, in general, but there has been issues with how clean water is provided to citizens within the United States of America. I'll bring up Saint Aubin in Merrimack. I'll bring up Flint, Michigan, and I'll bring up all the data centers right now that are being produced and completed against citizens Wants and needs, and it's dirtying our water. I'm very concerned about the environment, and if there's nothing that's in front of you that's a list of chemicals being used, how can you say that they're friendly and EPA safe and not gonna affect my well and the scapula and the fish and the environment and the ecosystem? Okay. Chemicals. Traffic, refer back to this. Customer visits will be limited, quiet, and by appointment, ensuring that traffic and noise remain minimal and in keeping with the neighborhood's residential nature. that's fine. I understand it's probably gonna be by appointment, it's probably gonna be limited. How can you control how your customers are gonna intera- like behave and interact? You can't say for, with one hundred percent guarantee, you're not gonna have an angry customer that's not happy with the service that you provided. And how are you going to be able to say beforehand how they're gonna act? If they're not happy. That, well, that can be said for any business. And that can be said for any business. Right. You had a great response, but I, I, I completely understand. I'm just making the point that it can be said for any business. It can be said for any business. I agree. Particularly if you're cutting the hair. It also could be-- Not you, but just in general. For just for a spouse. Yeah, true, but you're also opening up future possibilities for more- Instances to happen versus keeping it status quo, correct? Okay. Good point. Yep. you already said obviously that you can put Points in place when it comes to selling, so if they sell, that's not gonna carry over, it would have to be reevaluated by the council, so that's one that I'll scratch from the record right there. personally, when we were searching for a home, we really did pay that attention to like residential zoning, and we did make a conscious effort to not purchase in zones that would allow for commercial businesses because we wanted to purchase a property in a neighborhood So, I mean, as much as, yes, I wish everybody the best endeavors on their personal business, it's a neighborhood, it's a small neighborhood. I don't think Personally, in my opinion, that it's beneficial to the neighborhood overall. A special exception is, to me, I don't wanna say selfish, but that's one person versus the whole neighborhood So I, I just don't think that it's beneficial to all the other residents overall. we're straight across, exactly, and we're straight across. So we're the ones that are really gonna have to, and we're eighteen page nine, I don't know, no, no, no, that's, that's eighteen, yes. Yes, right. I love Mark and Angela, they've been fantastic neighbors. my concerns center around not necessarily the traffic, now having heard Mark and his plan, you know, I didn't know if it was Six cars a day, one car a week so that makes me feel better. my concerns center around water quality and the environment. our cul-de-sac, it's eleven houses it's not huge, and we are, we are bordered on all sides by wetland and the river. so I guess I'm, I'm concerned about how the, you know, you wash a car and, and you know, according to EPA, if you wash brake, you wash brake pads, yeah. you have heavy metals going into the water like lead, like nickel you have antifreeze, you're increasing the phosphates and nitrates, and you're producing overgrowth, and in a wetland area, you know, you could, you could kill off some, some, some species and some, some ecosystems just, just by, you know, eutrophication and You know, that, that's a concern. we all have well water in the neighborhood. you know, we've spent, we've spent a considerable amount of money on water quality systems, and we have high levels of arsenic already that we're battling. and so I, I guess I'm just concerned about what that business will do to our water quality. and Yeah, I think, I think those are my, those are my major concerns. Yeah. And I, I know, I know it's limited, you know, one car is a week, but it, it builds up, and I think it has, it can, it can have a long-lasting impact beyond what we think one car would do. So that-- those are just- Sharing my concerns. Great, yeah, thank you very much. Are there other voters that would like to speak? I guess the only thing I would add to my wife's statement was just the when I researched it real quick, it said if you had like a gravel pad and that it would be better than like doing it on tar and letting it wash into a culvert, into a swale, drainage swale, and get right into the system. If you know Mark, his lawn is pristine. I don't see that happening. I see it all happening on the tar asphalt, which again, as everyone else has said, just all leads right to the little brook and down the road and into the river. and the other question that I had that might be on that application, I didn't read it, is if I wasn't sure if Mark had permission from the deponent, as there are covenants that prohibit anything then other than in home office. So covenants aren't something that we would be addressing from the Zillow perspective you know, however You know, there is relief there in terms of either taking it to planning or but, but we, we can't act on that particular issue that, that's from our attorney, so And again, I was just asking in case Mark, if like when I got six chickens, the declarant gave me written permission. Seth may have six chickens, the declarant. Who's that? Tris Gordon and Robert Hugener had given me that written letter allowing me to have that. So otherwise, I think the, the covenants stick for thirty years and then they, they re up every five years unless two thirds of the neighborhood votes to kill them. so yeah, to your point, whether this passes or not, anybody in the neighborhood that wants to move forward after this could potentially, yeah, it's not inappropriate. So if, if it limits personal business-- My point is, is if it limits personal businesses, if that's what the, the, the covenant truly says, and you can't get permission from- In your deed restriction or whatever the case may be to do this, then we can't overturn that. You know what I mean? If they say no, they run there in your deed, we aren't. So if we say yes, that's correct. And they say no, it's done to no. I, I'm just trying to-- I'm, I'm trying to- I guess do it in the right order because I just don't, I don't wanna say yes or no here and they say no and then you look at me saying the zoning board said it was okay. We are second in command to someone you deal with. Well, okay. So you're before us this evening asking for a special exception, and technically that's all that we can rule on. You can come to us and say, "Hey, there are declarations on this land." We don't know anything about that it's not part of our purview. And so what would end up happening, building inspector and the review of all of that, and also the landowners who know that there are issues, would be raising that issue So regardless of whether we approve something, if there's something that's gonna overrule that, so be it that has probably over, you know, authority over what we're gonna decide, we can only look at zoning, zoning ordinances And whether or not the application meets the criteria for a special exception, that's all we know. I, I just will raise again, okay, you had said before with the other people who wanted the garage, is there any impact beyond-- I don't know your wording, but beyond The land or beyond, it's impacting other people.
