So this would be my first public hearing as a chairman, so I'm going to be meaning to me. So would we normally do the opening of the meeting and the Pledge of Allegiance before the hearing, or would we save that for after? I was going to say, no, we normally do that no matter what. We can certainly do that. I would say just do that. It's fine. But I would open the select board meeting because the public hearing is a separate event. Correct. That kind of makes sense. We will not call the order. We'll not do roll call. We'll just do the Pledge of Allegiance at 530 and then we'll go right in the meeting. And I have copies of things that we need to sign related to everything over here as well. Yeah, I mean, I would say you want to open it as a public hearing on this subject. That makes sense. sir how are you yes exactly yeah I mean there are state sets in many ways and you can decide in the town how are you going to actually implement I think it's a good idea if you're in a disadvantage you don't have opportunities because we don't have commercial and I didn't know this it's over by Fitch's Park but it's been a little I'm going to be having a special town meeting hearing before our town select board meeting but I'd like to ask everyone to join me for this I pledge allegiance to the flag of the United States of America and to the republic for which it stands one nation under God indivisible with liberty and justice for all I can't take these data everyone so tonight the Wilton select board is having a public hearing here in the courtroom for the purpose of discussing an upcoming special town meeting to be held on May 4th 2026 at 6pm to see if the town of Wilton will vote to one adopt RSA 72 colon 81 and two appoint the select board as agents to expend the revaluation capital reserve fund so the first thing the RSA 72 81 and Mr. Williams perhaps would you like to kind of review what that entails because you're more familiar with it than I am yeah I mean this was something that that I actually put forward for us to do because I thought we actually had already done this in the past but bond that we had and what this does is it creates an incentive for businesses to invest in Wilton by doing new construction and getting a partial tax break for a limited period of time on that new construction on how much that new construction increases the value of their property so it's it's it's it's not a guarantee because there needs to be an indication that there is a benefit the public benefit is defined in the warrant one of any one of the following enhancement of economic growth and increase of the town's tax base creation of needed services or facilities not currently available in the town redevelopment and revitalization of commercial or industrial areas within the town prevention or elimination of blight and by the way we need to add the of in that line retention of jobs in the town increase of the town's job base and or diversification of the town's job base so basically the idea is that the select board has some flexibility in whether they would allow a particular business to take advantage of this because that business needs to show what that what they're doing how it's going to meet one of those public benefit items so jobs something we don't have or you know fixing up property that otherwise might be considered a blight I mean those things are valuable to the town and we've obviously talked about how property taxes have become a burden for a lot of people if not everybody and anything that we can do that will make it possible to spread the property tax cost out a little bit more is a good for everybody okay so I highly recommend this and I join Mr. Williams in recommending this as well I think it's something that would have significant benefit I think the way to look at it is it's not that we're reducing someone's taxes we are using it as an encouragement for someone to come in and build something that would then generate a portion of the taxes immediately and the balance of the taxes over a period of time so anything that this would go towards would not impact existing taxpayers because it would not reduce any existing tax charges or fees it would only apply to new construction that would generate taxes it's just we'll get them at a reduced rate for a period of time and then permanently forever as long as the property exists we'll get them at a full rate so hopefully that makes sense to everybody it made sense to me I'll thank the economic development committee for bringing forth this Jennifer came in and spoke to this as well so can you think of anything else to add well the second second item on the list is our mistake yes because every five years the town is required by the state to do a revaluation of all the properties in town we did our last one in 2021 and we long ago in the 2015 town meeting as it says in the warrant set up a mechanism where we would put aside a portion of the funds that are required to do that town wide revaluation is about $50,000 is the estimate and rather than putting it all into a budget for the year that you actually do it we set aside a little bit every year and that makes it a little less taxing so to speak but also guarantees that we have the money because we have to do this this isn't an option this is a requirement from the state of New Hampshire so because we didn't we voted to put the $10,000 for the final amount into this capital reserve but we neglected to also vote to allow that money to be spent for the 2026 reval and so what this does we can't vote on money at a special town meeting without really complicated process process includes asking a court to rule that we can have the meeting and it also if you're spending money it requires that you get half of the voters to attend and that would be a challenge I don't think half of the voters have attended a town meeting since probably back when they used to hold them upstairs in the theater but what this would allow us to do is it would allow the select board to take that money and use it for the purposes it was intended for it can't be spent on something else but otherwise we would most likely have to find the money elsewhere and then at next year's town meeting vote to reimburse the town and where the money that we should have always spent it on so I think both of these are reasonable requests and I hope that people supported it at this special town meeting and I'll give credit Mr. Torrey trustee of the trust funds for bringing it to our attention about failure to include that line I believe in the warrant so thank you for catching that sir so at this point if there's nothing else to add I would open it up to any questions Mr. Fish would you like to come up and join us make sure you identify yourself and where you live Matt Fish Curtis by the way DJ and I noticed that two selectmen MRNs would be here on Facebook so properly notice me I'm all in favor of the law the law that you thought that we enacted was like 79E but that was the downtown district commercial different things yeah I was unaware of when this one was authorized but I'm totally in favor of it the way that I understand the process when I read the RSA first I thought the RSA was very very loose which was interesting that basically you're required to hold the public hearing to authorize a special time meeting the select board will promogulate a warrant and from my conversation with Nick is that the warrant has to basically provide the guard rails of how it's going to work mechanically that allow the legislative body approves the warrant and empowers the select board the executive to implement it's with the wording of the warrant article my only concern is that I'm totally in favor for it but I'm concerned about the seemingly implication of the town select board picking winners and losers I think it should be consistent or I think that the warrant article should offer two options or identify essentially the meat of the issue is whether they authorize the select board to negotiate individually on a case by case basis with differing results or if the warrant article has the option or direction that the select board is authorized to do this but it's a set whatever rate or reduction and assessment across the board as a percent and I think that all industries whether we like them or not should be should be eligible I understand the part that we want to attract certain industries ones we could talk to Jennifer and see what those are there's ones that we don't want sewage plants and stuff like that that have been proposed over the years don't forget asphalt plants stuff like that so there's some pitfalls on that but that's my major concern is that it's administered fairly and clearly and evenly so I mean and I certainly hope that that's what this board will do I don't believe that we can create it in a way that essentially requires a future select board to approve I think the way the RSA is written they depend on the executive to make the decision and again we're basically saying that it has to be based on this public benefit and that again is what the RSA says so I think I would certainly hope that any future select board would judge it based on not on like you said winners and losers kind of thing or saying we'd like a steakhouse but not a seafood or something like that that we can say it meets this public benefit measurement and therefore we should approve it but I don't believe that we can bind the select board to require it and to echo Tom's sentiment I truly believe that this is about reducing property taxes and residentials by trying to attract commercial and industrial development and we're at a loss if we do not have this tool in our toolbox and other communities do and they do exactly so that's another reason why we should definitely have this well going back to the master plan and the work for the echo debt committee put together everybody wants the town to remain the same but they also want to see taxes reduced and what they don't want is a whole bunch of additional residential development but I think everyone's in agreement that some commercial industrial in those zoned areas would be beneficial right and commercial tax base and industrial are the cream on the crop they don't go to school they have a disproportionate lower share of emergency services it's what we really need to do at the planning board and I don't think there's any other planning board members here so I don't have to worry about talking about this without a notice we're talking about removing the school portion of the impact fees because it's sort of unfair and we want to be competitive in attracting these things and I personally want to talk about the underlying zoning requirements to the land that's across from basically all around from 101 down from house by the side of the road where it has this arcane trip generation that's tied to lot size and the last application we've had two applications there both of which were not what we really wanted one was a private liquid waste servicing that was going to eat up like 80% of our capacity with the sewer which is definitely a no-go that would have stopped other commercial development and the one about 15 years ago maybe later was a gigantic mega truck stop and because of the high number of trips in and out when a trip is you come to work that's one trip you leave for lunch that's one trip come back from lunch that's one trip you go home it's one trip so that's four trips so for a giant mega truck stop the trip numbers were so high that the applicant needed to reconfigure the eight lot industrial subdivision into a 36 acre lot and you only needed two acres so that's 30 acres of prime commercial land that would not be able to be put into circulation as projects so I personally want to revisit that and discuss some of those practical low hanging fruit zoning issues but I've said what I want to say and I'll see the floor thank you Mr. Fish is there anyone else that would like to speak Mr. Keefe please join us at the table identify yourself and your actress good evening I'm William Keefe I'm your moderator I'm here as a private individual my question is we had town meeting 38 days ago why are we dealing with what I consider to be a fairly substantive piece of legislation 38 days after town meeting and what bugs me is we have trouble enough getting people out to town meeting but here we are trying to you're not going to get you're going to have the meeting here which means you're not expecting more than a handful maybe 20 30 people it's kind of disenfranchising the voters we have a town meeting form of government is there a reason why we're doing this now so we were we were very seriously talking about doing trying to add this to the war so this came to my attention that we hadn't actually implemented it previously and I think there's at least one business who would potentially make an investment in the town partially based on having this in place and so we felt like this is something that we don't want to wait until next year's town meeting for we just couldn't get all the things in place in order to put it in because that was my first inclination was to add it to the warrant for the town meeting that we just held but getting that in place we just didn't have the time for it and we didn't want to violate any rules around the process you know you obviously got to have a public aid and all that sort of thing Mr. Williams chairman was trying very hard to get a special meeting of the select board to try to get this on the warrant the warrant was literally already published at that point it had already been posted but we hadn't submitted it I believe it was right in that in between area and I was pretty adamant that I didn't want to try to ram something through onto the warrant after it had already been published we'd already had a public budget hearing it was no opportunity to have a hearing before the town meeting because it was literally just like the week before so I agreed that as soon as we got through town meeting that I would be willing to bring this back up so that we could do this but I do apologize because I agree with you certainly it would have been better served to have it brought forward to the town meeting with the other 35 warrant articles it's just not fair to the voters to bring it up and you guys are a great board but I can see if this becomes habit if the select board has some future select board which may not have your sense of duty wants to ram things through they're not going to bring them up at town meeting they're going to do a special town meeting a few weeks later which nobody shows up except the proponents of it it's just not a good thing but as I mentioned there's very few things that you can do at a special town meeting without jumping through a lot of hoops we've done one of those you were part of that one that all we did was we changed how the special heating system that was everyone understands that you didn't have any heat in the building and we needed heat but this is a policy decision that really should be within the purview of our traditional town meeting you should put it off until next year that's my two cents I don't want to weigh in on it but that's fine we hope that you'll be able to either be there or designate your deputy town moderator if we do go forward with this meeting and we've posted it and we're probably going to have it so it's valid but again I'll take responsibility Jennifer would you like to come up yeah I actually want to respond to Bill please identify yourself and where you Jennifer Beck Ty Farm Road thank you Jennifer so let me also fall on my sword as to why this is happening at a special town meeting instead of the one that we actually had I completely agree with you well however it's something that economic development has been considering but we didn't see an opportunity why we needed to do it right now the timing of the opportunity and our competition with other towns for luring in some of these businesses hit at the wrong time and the wrong place and waiting now would put us at a severe disadvantage if we didn't actually move on it right now but you're absolutely right and it's not about spending money it's about giving us a competitive advantage to attract the businesses and the commercial enterprises that the people frankly have asked us to do and all the surveying we've done all the conversations it's I don't want to lose the opportunity and this is the way that we capture it and it means a lot to this here on the country yeah to me this is making up for omissions both both both one and two are omissions that we should have dealt with in a regular town meeting but you know it slipped through the cracks and you know I will agree that we don't if we the longer we wait the more we run the risk of losing competitive towns that already have this in place yeah mr. garcia please join us DJ Garcia Pete Hill Road I found and chairman of the budget committee in town I was shared this information by the town administrator via email last week in a letter to the budget committee which I shared out to them few of the members are here today so thanks for coming I found that the town of Salem passed this a number of years back so I looked through their information that was publicly available and found a couple other associated RSAs one being 7282 and this just echoes what Bill is saying to a degree is that it actually can't take place it can't take a first until April 1st so we could very easily vote on this at our next town meeting and have it be able to be April 1st 2027 just to be clear obviously we passed that date actually that's not you're misinterpreting it the tax benefit will take effect until April 1st because that's the beginning of the tax year however an applicant can apply for it the day after it passes if we do this special town meeting so they won't see the benefit until April 1st because it's based only on the value that they add to the property right but it would always be true that April 1st is the first day of the new tax year whatever benefit they were granted would go into effect right so almost certainly if we did it next year at town meeting which I don't know what exact day that day would be but in the middle of March that people would miss being able to apply so they wouldn't start to see a benefit until April 1st of 2028 okay so they're going to lose a year right if we put it off well it sounds like between yourself and the chair of the economic development committee there is a candidate for wanting to apply for this so I'd love to know who that is firstly I'm a huge supporter of this I think that this is something the town of Wilton desperately needs and this is just me speaking as an individual not a chair of the budget committee I also believe that what Matt Fish was saying about changing the zoning up on 101 is highly important including extending our public infrastructure right through that zoning area as well and then the other thing that I was wondering is if the planning board could help determine what the public benefit actually is I know that you read something which I didn't see what is determined the public benefit but it says that the legislative body should define what public benefit actually is so again I guess I'm echoing all the comments that have previously been made which is why do we have to do this at the special town meeting because I was in the impression as a select in the past that special town meetings cost a lot of money and took a lot of energy and effort so I don't know why we're doing all that for this and maybe we just need to fix the agents to extend and then we toss this one on too but if there is somebody that the town is like basically pushing this through for to get the benefit for I think the public deserves to know that at least so that would be my comments on it so I'm not willing to put anybody out on a shingle and say you know they're going to do this because I don't know for sure that they are but you are willing to call a special town meeting for the town building but I think there are a number of places where there's potential for additional development including the mill across the river which we've talked about for years we talked about when you were on the board but there's no urgency with that there seems to be an urgency for this it just seems like a little bit of inside baseball to me and I don't think I like the way that that feels or sounds so I'm echoing some of the comments previously and I think if there is somebody and there's a reason that you're doing this that the public should at least know because we're going to be the ones putting the bill at least 50% of it for the first 10 years and the last thing I'll say is that this is only active for five years so in the event that it is a large candidate that wants to bring something sometimes development can take that long for these large entities so I don't have the vantage point on that but it sounds like you might so maybe you should just tell us who it is I'll respond to that I think in a public forum we're not allowed nor is it appropriate to reveal the name of individual companies that may or may not decide to take advantage I will tell you that the timing is a competitive situation just to echo what Jennifer said and we did meet with an attorney but they were very clear that they did not want this publicly announced but it is 10 years just to be that's what the draft warrant and I'm sorry it should be copies of the draft warrant but we can make copies of the draft warrant it is 10 years 50% not five years no the five years is the implementation of this so this sunsets after five years and if the town wants to renew it they can renew it maximum duration the exemption should not exceed 10 years if someone applies within the five years they have the full 10 years of exemption I was not really initially in favor with the seat of the DJ because it did seem to me like we were tailoring a whole RSA and thus the need for a special town meeting for one opportunity but when they presented it to us it was very much in benefit for the town in my opinion and I thought that when people become aware of what they're proposing and what they want to do I think they'll see that there's significant benefit to it and it will definitely generate additional revenue for the town because it's a development that could or could not happen depending on whether or not this RSA is implemented it does happen I certainly hope we get a lot well it'd be great if we got more but I'm not excited about the one that seemed right and again there are a number of things that we have at least had preliminary discussions around that could happen and any incentive that makes it more likely to happen is a good thing and you know well I will agree that you can sort of make the case that the taxpayers are footing the bill in the sense that you don't get 100% of the taxes collected but you get 0% of any taxes that happen because a property gets built somewhere else and not broken. Is there anyone else that would like to comment just to make sure we don't miss anybody? only the reason I ask is that we're probably going to wrap up at 6 so we can start our regular meeting at 6 o'clock but I want to make sure everybody has and if anybody wanted to comment remotely and I should have mentioned this at the beginning of the meeting you can comment remotely by sending an email to admin assist at wiltonnh.gov and we'll take any comments that come in. Mr. Jermaine. Yeah unless there's more members of the public. I have one quick question. Is there any discussion in terms of the size of the reduction in the assessment or essentially the tax rate? Are we talking 50%? 50%? 50% up to 50% from a period. It shall not exceed. Not shall not exceed. Did you see any numbers of what other towns have been doing? So yeah that's another thing to point out is that the Warren article that's presented is essentially can be modeled to endorse certain things and there's two models that ultimately seem to be kind of like popular in the state. It's the decreasing model that seems to be popular in the more busier communities that have a lot of development priority going on and then the more general ones that seems to be popular in a lot of places as well which is what the version that will the select board approve for this part of the town meeting. So I think an important part of this RSA one way or another that it and I think when I first heard about it it matches up with things that members of the public and other you know different town organs for information collecting and feedback loops kind of like present for town is that it allows discretion in a big way and there has to be a real justification for that. I don't know necessarily what other communities do for this as far as how rigorous their process the applications are for the select board but to me the select board should be discreet should be considering these applications in a serious way. Do these developments that might come forward have a public benefit to them that's realistic and that weighs the cost? I know Select and Krauser was during the discussion process was very serious about that saying for example we should be always weighing the cost benefits of that so if it's just some random development that isn't representing a lot of benefit for the town I would hope that the select board doesn't adopt the application just because it's just to get a little bit more development down because I think really there is a real sense and we know that from things like the town's police operations study and other things is that capacity building is a serious issue. We see that in the schools for town services that supply these different organizations so and that's a relatively simple thing to think out in many cases for the kind of development that occurs. I mean we probably have a lot of flex right now for town services and what's actually provided in town but if there's a business that's opening up on an open lot for example that might create some jobs in town that sounds like it would be a pretty good development if it otherwise isn't going to develop for example or if there's some sort of public business that provides a service that isn't easily accessible in town right now that might also be a good reason for it. I think this ultimately popped up because the select board and different entities in town have been hearing the calls for that they want some sort of support for things that end up in the town's master plan chapters economic development different attractions and services all those you can find in this current master plan chapter that's developed or past ones. And the honest truth is that Wilton has some disadvantages against other communities and that is the reason why certain parts of the town aren't developed even though they're zoned correctly towards trying to attract that So this isn't a guarantee that it's going to be used all the time it isn't necessarily a guarantee that's the kind of thing that is necessarily going like something that's going to be even though it's just an arrow in the quiver I'd probably say for the select board to try and be responsive to what's in the master plan Most of the other communities that I've kind of looked at that have adopted it they have applications for it I've looked at applications for a few communities that popped up I don't know necessarily how often they're getting used and what I would say is that I would encourage any town in the town when it's developing its application process should this go forward is that they Model it on these other towns Model and then also have some real discipline with enacting because honestly I really do think that you're going to do up the taxes sometimes for these applications and you're going to say is this development going to make sense to have a real public benefit is the down cost that you're going to take for that on the property taxes is that worth it so easiest thing would be development that is not going to be occurring without it some sort of reasonable justification around it or things that actually have a public benefit that's tangible I just want to reiterate that I am hugely in favor of this I think that this is something the town of Wilton desperately needs including rezoning the area 101 and extending our public infrastructure up 101 all the way to the border and I appreciate the select board for addressing the concerns because we heard them at town meeting and throughout the budget process that we need to diversify our tax base so I'm not knocking you guys in any way for this I just I am a strong supporter of it and I want to be on record that this is what the town needs and I've been saying that for as long as my voice has been ringing in this hallway so I appreciate it thank you Mr. Garcia real quick question if I could ask one does Milford have this yes and if anyone has noticed next to Irving there's another commercial industrial development being built I understand it might be a fast food restaurant and I would note the fact that it's the second or third industrial development that's literally hundreds of feet from the town line and the reason that they develop dollar general or a gas station or a fast food restaurant right on the town line is is that because they can attract from this community people and money to go out of this community and be spent out of town and I think that's one of the reasons why it's important we make ourselves proactively attractive to businesses to build in our town and that reminds me because I think a lot of people I think for some people that are less converse in town government they don't really understand zoning all that much in some respects but the important thing is that this is commercial and industrial development correct so areas that are already zoned that way are infinitely more likely to put in an application to this and it would be a public application process so once you get this approved if a business comes in then it becomes public correct there will be no non-publics to pick who gets what and then also just in 7281 in section A and B it asks you to define specifically if it's the entire municipality or only certain so I was going to make that point you know because there was this idea of you know not wanting the board to pick winners and losers we could have chosen to say okay we just want to do it in this particular area like just downtown or just 101 or whatever but I thought that was unfair because we don't know where somebody wants to build a municipal or industrial property and obviously if it's outside of the proper zoning they would have to go through a whole process to do that but we have industrial properties all around town we have commercial zones all around town and we want people to be able to take advantage of this from wherever they are going to be properly building we didn't want to lock it into a particular area one comment on that yes sir kind of like soil based zoning which Wilson left in 2001 because in 1968 there was 8 colors of crayons and in the 70s there was 16 there was 30 colors and there was 64 colors unless your zoning like Limbrough found out last year completely mimics the USDA soil classification your zoning becomes moved so if the if we were to talk to Warren article that said that this specific spot is going to be it only that's present day but what happens 20 years now we adjust those zoning districts now you're going to have to have a housekeeping warrant article to adjust this language itself so I think you're better off just using the districts as opposed to specific areas within a particular district and happily it does I think the legislature was very when they were setting this RSA up they were conscientious that this could be misused or used so that's why there's sunset classes and re-adoption classes so that it isn't just commercial developers that are you know getting the benefit of this law well if that that's it for comments I'd like to close the hearing if that's possible is acceptable to everyone and should we take a motion to close the hearing or should we just go ahead and I'd like to close this public hearing at this time and I would like to immediately go into our agenda for the regular select board meeting and I encourage everyone to stay because we love having company so call order roll call Tom how public comments if you're asking a direct question the answer is we've not told or made any direction to any department heads or any department to do anything relative to you or your property that's kind of strange that he and I've had visits from every official in this here police fire building inspector everybody come visit me I'd like to tell the fire the building inspector if he has any issues with my property to talk to me not to a resident of my property because I own the property all right the other thing is signs so obviously you're not going to do anything about signs just new business agenda was ada digital accessibility requirement for municipalities that has been tabled for our next meeting may 4th correct janice yes then the next item on the agenda is the willton celebration of america's 250 so janice if you'd like so you can speak to this because you've sat in on the meetings and nick has as well well the main thing we wanted to let everybody know about tonight was that as part of the festivities on saturday may 9th there will be an event called planting history liberty tree dedications and that will be at 10 o'clock now there are two liberty trees that have been donated and they are already planted but the dedication will happen right there where the trees are and tom has a proclamation that they've asked us to read and accepting these trees i'll read it i'll briefly read through the resolution the resolution of the town of wilton new hampshire to accept the gift of two liberty trees in honor of the 250th anniversary of american independence and it speaks to whereas the year 2026 marks the 250th anniversary of the founding of the united states of america milestone and profound historical significance of the citizens of wilton and then it goes on with several whereas's and then therefore it will be resolved by the town of wilton this fall section 1 of the town of wilton hereby gratefully accepts the gift of two princeton elms liberty trees from the wilton 250 committee the sons of the american revolution and the daughters of the american revolution the trees shall be planted at whiting park and shall be maintained by the town a suitable marker plaque shall be installed and these have been provided by the three committees with each of the trees there will be granite markers that will be installed in the ground and the select board and the town of wilton extends its sincere gratitude to the wilton 250 committee the sons of the american revolution and the daughters of the american revolution for this meaningful already ordered the trees and the plaques they just want to get the towns trees were installed they already planted the trees I thought they were planting them that day they dug the holes all right people to go to the website i think it's wilton 250 wilton nh250 and also there was a mass mailing done to all residents mailboxes and po boxes so that everyone in town should have gotten some information on this event and we're very much looking forward to this i think this would be an excellent event and there are lots of different things to do during that that week oh absolutely hopefully there's something for everybody and i really encourage people to come all right so i've signed this you are and i dated it as well next thing on the agenda is the 2026 paving bids john you want to join us and we got copies of a couple paving bids so the one you have in the four of you chairman is the low bid we also received three other bids for the town's full-blown paving contract okay and this would be the bid from r&d paving of franklin massachusetts total base bid price all parts $355,443 and 70 cents yes and the other three bids were well above that so the next closest ones were the 390s so and the high bid from what was this plus B all states was up in the 470s so so far it looks like it sounds like the bid prices were relatively stable i mean i guess we'll see what the pavement adjustment is once we get around to when they do the scummer but since we did it relatively early hopefully we'll be able to get them in relatively early as well so let's not drag it out and john i have your note here moving forward with the 2026 paving season you will recommend r&d paving they were excellent to work with last year and did a professional job while accommodating our schedule they are also a little big and with this contract came in lower than expected i would like to add some work to the schedule the top of curtis farm road and hire all all states construction and complete rubberized chip seal of three streets attach sheet for information and there's a proposal from all states construction that's on the reverse of this and if everybody can remember all states is one of the few and actually might be the only game in the only one in the town for doing this process for the rubberized chip seal right are there any questions mr williams on the bid we'll talk about the the bid first for the paving and then we'll talk about the other thing so the budget the paving budget would encompass would cover the cost of not only the bid that we're potentially accepting but also these additional costs yes i'm fine well if there's no other further questions or discussion i will set the motion to accept the bid from rnd paving from franklin massachusetts so i would move to authorize the town administrator and the dpw director to contract with rnd paving for 2026 paving season in wildland and i would additionally authorize additional work being doing two inches of top on curtis farm road for a cost of sixty thousand sixty two dollars and fourteen cents and additionally to hire all states of construction to complete rubberized chip seal for the three streets outlined in their proposal contract for a total amount of eighty two thousand four hundred sixty two dollars and seventy five cents motion has been made i'll second that motion and how much do costs skyrocketing for it but they also have one if it goes down it goes down too every day is different so if it comes to that point where we get to it and it's too much to do the overlay on curtis of people coming to town for the specifically on the may 9th event is there an opportunity to maybe get the crosswalks on main street painted i am hoping that the weather will cooperate as soon as we get one good day or it's going to take a couple days actually i drove around town today and i know that there's multiple other crosswalks there's crosswalks around the elementary school there's crosswalks on maple street there's crosswalks on lower main street i recognize that you can't do all of them if there was a priority i would like the least three or four on this section of main street specifically the ones that are painted in with red that would be really good i will tell you that on the crosswalk on this hump that we temporarily painted people were no longer stopping for people because i've stood in that crosswalk multiple times and have cars just drive right by me nobody's stopping for it anymore because it's completely blacked out and it is going to become a hazard so i really would like to see that get done if i could as soon as we have a good day we will get on when you can get to it would be great thank you sir these are approved so i should go ahead and sign this there is a minor adjustment i think it translates out to a couple thousand dollars a year essentially and i have a copy of the resolution here um i'm looking for where the motion would be in this there's an amount somewhere in here do we have to put on a motion i see a price of 347 900 at the end of this you know but well i'm not sure it's really yours it'd be his because it's on the financing and tax exempt leasing and the governing body has determined that the agreement and schedule substantially in the form presented are in the best interest of the lessee for the acquisition of such equipment and thereby and therefore the governing body hereby approves the entering into the agreement and schedule by the lessee and desigates and doesn't authorizes the person to deliver the agreement and schedule unless he's behalf with changes thereto such as such persons deem appropriate any related documents including any escrow agreement necessary to the consummation of the transaction contemplated by the agreement and schedule so I would further move that the authorized individual be the town administrator and in addition to the authorized individual the governing body further authorize the following individual to sign any payment request and partial acceptance form and or final acceptance certificate can I assume that should be you because you're the one that can determine whether it's the way you want it so I would move that we authorize the ambulance director to be that authorized individual and that completes a very complicated motion were you able to I will move on to old business so the first thing on old business is infrastructure updates this combines all the previous updates that we did at the last meeting for buildings bridges dams town hall all in one thing so I'll leave it to you Mr. Jermaine for updates and I think also that would include the highway garage because I don't see that listed here so not a lot of updates right now we're still kind of dancing around getting a schedule in a meeting with Gomez and Sullivan and the state dam bureau for all over the state but obviously everybody saw the nice work that the highway did over at the dam cleaning it up they also got the siphon fixed and I believe they put in on a new did a nice upgrade to the siphon so it'll be easier to turn on and off in the future which is very welcome as a reminder we have to control the levels on the siphon at least I believe it's a foot above the lower intake we let it get a little higher than normal after spring just so we clear out some of the extra debris there I guess we'll see what the dam bureau things when they eventually come out as far as the last letter of deficiency so we'll see where that all ends up one way or another the highway garage I'm actually going to be going out to Manchester to hand off before the budget committee meeting tomorrow to hand off the plans for the one piece of property that was previously discussed I haven't had an update about the accessibility of the second piece of property that's getting looked into I've met with the theater keeper a couple times regarding the electrical work the electrical system upstairs and I'm definitely thinking that's going to be an interesting process I mean the electrical hookups for how everything works up there isn't exactly straightforward unfortunately so I think the best we'd be able to do on short notice without a much bigger project potentially I doubt we're going to attract some lighting expert in for this kind of thing right now but I think it really does need entire panel upgrades and entire control system upgrades which is I don't know if it's necessarily conducive to the town's budget at this time or its schedule I guess we were trying to time it with the sprinkler system or necessary necessarily because I think the sprinkler system is going to be put in by scaffold and if we use the existing fixtures for the floor that I mean they go through the roof for example or the ceiling so the big problem is just navigating and not falling through the drywall the drywall and lay that would be bad but I took some pictures and I have a little bit better of the idea and I'll try and explain that in RFP that I'm going to be putting out and hopefully we'll get something back related to that as far as bridges we successfully obviously did the cutting in time for the April 15 deadline for the environmental obligation for the I believe it was we were supposed to cut down the trees in the construction area for King Brookley Bridge for a black river tree they met the deadline I believe it was a bat I don't have any updates on this time I know every time I go into the economic development advisory committee they ask about progress for what the schedule is going to be for the potential for a future pedestrian bridge between the road and the C-back our selected contractor for that Hoyland Tanner they haven't gotten back to us yet but hopefully we'll be able to get a better idea of a timeline once things clear up for them a little bit for Temple Road Bridge I'm sort of preparing some draft documents to notify the residents in the area because that's going to be a very complicated and impactful bridge installation when it eventually gets done but I think it'll help a little bit anyway if we start way ahead of time just like reach out and say hey this is going to be happening these are the potential impacts for it we don't know what they're necessarily going to be yet even though we're going to have an engineering study for it and just see what ultimately ends up for that did I touch everything anything anything on the roof for the people nope like I said there previously I think that'll just be whenever the GDC he doesn't have a his contract isn't obligated to have a timing basically it's pretty flexible to fit in with his schedule but he's going to be he is aware that we have leaks that far that's why I asked about it because we still have the same leaks that we had until we come to fix this I'm thankful to the town hall upkeep for preventing those leaks from spreading and doing more damage the only other thing is the that I can think of off the top of my head is the ADA accessibility project yes they were that's the item that we tabled right oh that was digital accessibility no this is for the physical right yeah this is for the ramp right that's a different thing I'm sorry you're right so go ahead we asked the town's contractor to come by and stop by and he was nice enough to meet with Jackie Chacale myself and the town clerk's office to talk things over a little bit he received input from the town regarding some of the concerns about falling snow so they're going to be looking into some options and the potential impacts for it some of the architect you say contractor yeah I mean he is a consultant oh where it's a terminology lingo thing oh you say contractor not consultant yeah I guess he is technically a contractor all of the above I guess but yeah there's he's going to come forward some potential proposals one way or another for different options all of it spells more I mean he was originally quoting less than $30,000 but some of the changes that we're talking about all in is going to be a lot more than $30,000 so maybe we won't be able to get it done this year oh no that's not what I want to hear no we went to town meeting to get the balance everybody has anything again so we'll find I'm well aware of that so we will find out I guess but we do want to keep moving forward this is one of my action items for this year I want to get completed or at least know that we're going to be able unfortunately it might be impossible but we'll certainly move forward all right that's it for infrastructure right so I have a point to make so at our most recent NRPC meeting it was announced that the state is changing the TIP which is the next three years worth of the 10 year plan that's the things that are in progress and they're taking the the Old County Farm Road bridge out of the TIP which again that was my reaction too what they said was that the reason why they're taking it out of the TIP is because things in the TIP are done with federal funds and they have as we have discussed previously decided to do this project with state funds with the red list funds and but they've also they have told us and I assume that this still sticks because the red list funds are with a 20% match and they told us that they were going to honor the original commitment for the federal funds where the town didn't have to have a 20% match for the construction piece just the engineering piece I was rather surprised that they did that I don't know if this was discussed in a previous I forget what the acronym is for the T-TAC so the group it got discussed but so far it doesn't seem like none of the people that are directly associated with the bridge aid project have given me any alarm about things basically when we talked about some of the funding changes with our project manager they didn't seem too concerned about some of the adjustments that are occurring and one more update is since Kingbrook Road Bridge did come back high we are going to have to wait to hear from them whether or not they're okay with their share just because of that approval but it didn't sound like there be any difficulty with these existing projects and William Rose who represents DOT for NRPC was present at the meeting and he said this was not going to affect being able to do the project it was really juggling things around for how they're paying I don't care how the state pays for it as long as they pay for it as long as they pay for it they can take the money to wherever they need to get from I mean I think there was part of this was they added an item to the tip for Merrimack and I think this was the way to juggle money around so that they could do that one so hopefully that won't affect ours and they indicated at least Rose indicated that it would but it's something we should keep an eye on I will assume Joseph is on top of this for from a contracting perspective okay anything else for infrastructure you can always if something comes up and it comes to mind you can do it under TA I mean that's we normally would do it anyways but I just wanted to make sure we pulled it out as a separate action item because I do want to keep it under boldness these things tend to just drag on and drag on and drag on and we're trying to move something forward next thing is payroll time and attendance system I know Mr. Windows not able to attend tonight and Gareth not here do we want to table this because they've both been involved so I'm going to ask you to table if you have some specific update nope we're starting to meet with department heads about getting more input seems to be at least the initial returns on it so okay select board participation and library trustees meeting so Mr. Tory this might be of interest to you go ahead so I'm going to turn this over to you Nick and you can give us the feedback on what you got from the legal well I would hold off mostly just because that is a legal opinion that we have but there is some merit potentially in some of the things about the number of trustees and who are ends up being trustees based on the deed and it's establishing documents in the RSA for it so I would hold off to review it in non-public and then give orders what you want to do I guess well I'm going to speak to this publicly because I had an opportunity and I know you probably haven't had an opportunity did you provide the rest of the board the part of the thing to discuss it in the public would be to provide did you get a copy of the legal love all right well then he hasn't seen the legal then there's no sense I will just say that I had an opportunity to read the legal opinion and I want to say that Mr. Tory I believe was correct in his understanding from what I can glean that we do have a position on that board of trustees as the chair of the board we should have a seat on that trustees and I think that's something that we should move forward with that's my opinion but again you haven't had a chance to read the legal so I'm not going to characterize I want you to have an opportunity I want Garrett to have an opportunity to read it so Mr. Tory would you like to speak to this while you're here please come up and sit down and identify yourself and your address I'm Joe Tory 609 Burton Highway trustee of the trust funds and a member of the budget committee this these the condition that I brought up that is that the chairman of the select board is one of the six trustees of the library as a result of two separate town meetings two separate warrant articles passed by the town accepting the conditions of Mr. Gregg's deed and if Mr. Gregg's deed is still legal then there is no question that the chairman of the select board is the sixth trustee appointed trustee if the chairman is unable to fill his role according to the conditions then the town is required to have an election to have a replacement for the chairman and that's why I recommend that the chairman accepts his position as a trustee unless there is some law that has happened between 1912 and today that makes those conditions illegal it's a contract that the town has with Mr. Gregg and I think when you say there was two Warren articles it was because there was one original one to accept the deed and then there was a later one to meet a later RSA no there was one to meet one to accept the library and there was one to accept the library trust fund and both of them speak to the conditions and this is one of the conditions so we do elect a public member to the library board that was not part of the original agreement because it had even numbers and so you can't have a board with even numbers it had to do with at some point a law passed that said that if a library was created based on a donation or some other transition from private to public so if we just said we need a library in the town of Wilton and the select board voted to raise the money and build a library there would be a public library board that's what the RSA calls for but because this library was built and donated by a private citizen with very specific set of rules about how the board of trustees would be created and how new trustees would be found that this state law which was enacted long after this all took place said that if that situation exists because we're not the only town that has a donated library then there shall be one member of the board and I believe it's an extra member it's not replacing one of the members designated they decided to add a seventh member which is the elected one I think what Mr. Torrey's point is that the original deed said that one of the six members is to be the chairman of the board of the but it says that if it isn't or that person would then be designate someone else I believe it calls for some sort of a vote by the citizens of the town right so the only thing I don't know and I haven't seen this legal opinion and we probably shouldn't be discussing it without having a chance to read it but it certainly would be a possibility that somebody could say the fact that we're electing a I've been chair of this board three times now and never really sought the position at the library but we've had this elected position in place for quite a while that that could be viewed as meeting that obligation of having a member of the public well I think it would be good to your point you haven't had a chance to read the legal opinion so read the legal opinion but I just wanted to note the fact that you brought this forward and I appreciate that because you did a lot of homework to dig out all of this data and stuff I mean it did seem to me that it was something that had been in place and at some point ended before we changed the board to add this elected position the select board did appoint a chairman but it was many years ago well I think somebody just didn't you know somebody decided they didn't want to be bothered anymore and so they just said we'll run it themselves but I think fiscally it would be behoove us to have close involvement I'm certainly willing to do it so but again I think we'll have to discuss it read the legal I have Gareth involved and everyone on the board can make a decision at that point thank you Mr. Torrey thank you all right we're back to special time meeting for tax credit on the agenda so I take it that we now have to decide what we want to warrant to say and if we want to make any changes would that be yeah tomorrow morning basically unless we choose a different date than May good night Mr. Torrey good night there was one typo which was prevention or elimination of blight the word of OF is the fourth line from the bottom of the first paragraph I would add that of in there I think Mr. Williams you noted that correct I did take seriously what everyone's comments were about their concerns about this I wanted to set responsibility it was really on me because I pushed back on trying to get this on the warrant at the last minute I really thought that it was too late with the warrant already being published but now I recognize that created this situation where we have to have this special time meeting but I think the general public comments were fairly positive towards this just understanding that we probably should not make a habit of trying to do special time meetings and I think we did the right thing by not saying who it was because we cannot do that I mean we were asked it's not in our purview it's not in our purview to release the name of a business who wants to expand or build in town because that puts them at a commercial or financial disadvantage so I hope people understand that that's the choice they should make yeah right and I would hope that they would as soon as we get this through so and you said it is sundown so it has to be renewed every five years yes so it's only basically a five year period so I'm fine with the way the warrant was written otherwise I like the 50% for 10 years I think that's the right way I think that's up to 50% at the decision and I think the comments about getting public input on an application process and how to generate an application and I think Nick you would be the one that would put that together right you got examples from other towns so if this does actually pass and everything like that I think it would be you know we could have a draft application process kind of set up for you and that could include you know requirements to have like notice the planning board and pass them to provide an opinion or something like that well yeah because we want buy in from them because you know it doesn't do us any good to say sure this is great and that planning board say no to everything so and we want to have this in place so that because like was mentioned in the public hearing yeah it's it won't it won't take effect in terms from a tax until April 1st of 2027 well April 1st of the tax year after somebody applies right so they'd have to apply before the deadline which would be February 1st or something like that right there's a February deadline to apply so that you have time to analyze the you know the application and make a final decision before April 1st right so you know gives the board a number of weeks to make that decision okay well listen I'm in general and I said this before I'm in favor of the warrant as it was drafted with that one minor correction if you want to make a motion to go ahead and set a date and I believe would May 4th still work would you have enough time that would be two weeks from tonight basically we have to get it out today though so I would move that we move ahead with the special town meeting to be held on May 9th here in the May 4th May 4th rather in the courtroom May 9th is our big party so we know might get more people to show up if you have the same day that's true but let's do it May 4th that is part of semi-quincentennial week so yes it is I will second that motion is there any further discussion and I guess further state that to to post the post it without here you are sir I think a couple times this town's history it's warrant has only been two two people so the last thing under old business is Dale Street and Peat Hill intersection and this is something that I asked to be put on the agenda I just wanted to highlight this because it was featured in a very well written article in our local newspaper and we did have a meeting with the residents of this building and I understand that the highway department has been met or gone out and looked at the intersection yeah clarification we haven't met with the resident yet correct but the offer was made and I think you made it in writing because I was copied on the most recent letter the offer was made in writing again to the residents to schedule a meeting correct yes so I just wanted to get that out there that if the residents are listening or if they're aware the offer has been remade to have a meeting on site and if you feel the need to have the police department there and the highway department I would highly recommend that well and since we're talking about just to clarify the reason why we're waiting as long is to get a full legal opinion on some of the options that were involved there and some of the legal implications for it so we have an idea of what's okay and what's not okay and I think Kermit you I'm still not quite sure about the mechanism for input from the state but I believe it has something to do with some of the dams up on beyond off the axis off the flood control dam well up that street so I think there is very well possibility that the state dictated what that intersection could actually look like but that said we don't have a lot of records of what that approval process was for but we talked about it with highway and police and there's some stuff we can do the one thing that I noted was is that the way the intersection is configured the stop sign is way to the right as you come down Peet Hill Road and there's no stop sign directly in line with cars as they come down the hill and from what it appears people are just slaloming through that intersection not aware that there's an actual stop line and stop sign to the right because the way the road was configured the stop sign is all the way over in the woods to the right and I would highly recommend a stop sign and come straight down Peet Hill right looking at that triangle because that way people would have a second warning that they have to stop there not that they can stop because of the weather but at least it covers the fact that they are aware they have a stop so I just wanted to highlight that that we're going to continue to move forward with that we took it seriously when it was presented to us and I'm happy that the town has been proactive about it so thank you John and John and Nick for keeping on top of that that ends old business the town administrator updates Nick most of the updates I had that were public were in infrastructure related to infrastructure and thank you for taking the time to you know I've had some meetings with the planning board officials and you know we're obviously going to be I got some input from the town departments that are kind of like relevant for typically relevant for the library regulations I'm actually surprised the planning board has reached out on other regulatory issues that they kind of want to get more involved with and get more input on and I've offered to help out with that as much as they're willing to kind of hear my input on it one way or another so well Matt Fish was here tonight and I mean he's now with the deputy chair I think he's very proactive about working with the board because obviously he's a former selectman so and I think John Miles I think they're both willing to work I know everybody has their role and I think one of the things in Wilton that I think is sort of unique here is that the traditional roles for some bodies are more fluid than other places or kind of there is an interesting culture here I guess I will say about responsibilities and how we do certain things in town around but that's in the spirit of more closer cooperation that's why I wrote the letters to the budget committee and the planning board and those were well written so thank you so hopefully if everybody works together we can address the challenges that's the goal but that was the major update I had select board items Mr. Williams do you have any announcements you'd like to make so I have a concern yes sir and I'm not sure who I should be addressing this to it's sort of a complicated issue and you know it might involve Nick and it might involve John maybe not John there's two of them so well might involve the police department theoretically so you guys know that the river's edge subdivision is being proceeded is being worked on and I don't believe anything has been done other than paving of the road going into that subdivision however apparently the current plans call for building a retention pond for controlling runoff from where these houses are going to go I don't know if you've ever been to that site I haven't driven up in it but this is across from the recycling site right and when they're done there's going to be a lot less sort of natural structure that somewhat retains of the runoff that runoff of the hillside because it's kind of a hillside and it flows into the South Egan and so long ago when they put this plan together there was a requirement to put a retention pond in place I recall the retention pond being in a different place from where I understand they're putting it so the issue is that to make this retention pond the land right next to the river is basically all ledge so it's in fact it's probably more than ledge it's probably bedrock so they are planning to blast and they have been drilling holes for this you've got to be able to figure out oh I saw the drawing right there I saw that and this retention pond is now going to be really close to 101 like within a few feet of 101 and I I don't know if the state is aware that this is going to happen I would be concerned about the potential for damage to 101 if somebody misplaces you know some charges how about damage to our water line well yeah so that was my specific issue not just the water line but the sewer line so there's a sewer line that goes within a few feet of where they are planning doing this blasting and it's a pressurized line because it comes from the the question is who will we bring this to the attention so what I would say and this is why we should talk about things before regular meetings and that sort of thing talk about it so there is a subdivision plan that would be a very easy matter to pull the plan out and see what the planning board last approved and also look at the conditions of approval for things and what was approved and what board construction there could be you can dictate for example that a retention pond is put in place before you start constructing homes or issuing stock I read the plans and I know they were going to put the retention pond in but I don't believe there was ever any discussion about blasting so the drilling they did up there if they were going to blast they'd have to blast right after or else the holes fill and they'd have to re-drill it's more for a fracking and cracking the ledge sits there so they drill a bunch of holes that cracks the ledge and then it's easier to rip it out or they can hydro frack it but I haven't seen the plans but the blasting itself it's not that wasn't typically drilled as you would blast okay so they crack the rock what I understand is they intend to blast I would agree that fracking it doing some sort of a fracture process would make more sense because it wouldn't require the potential for damaging other infrastructure and maybe that in the end would be what they would do so we just need a clarification of what's going on yeah and I'm not sure who would we you know so I mean I understand John it's not because it's not a town road it's not really they wouldn't necessarily contact you there's obviously that's a dig safe issue but apparently they don't contact the town water and sewer for dig safe in input input from the fire department sure you're going to hit every department on it probably so under the state fire code and the adoption of NFPA one town could issue blasting permits right now what typically happens what little blasting that takes place is we usually get a phone call but the town could fire chief could issue permits for blasting and initiate that program that's not currently in place but it could easily be done for the amount of times that we get those calls there are also requirements under their state license that they have to meet pre-blast surveys a lot of them take videotapes of structures and elements they don't just go in and blast because they realize that they would be liable for things that happen as a result of the blasting so there's a whole apparatus in place for your concerns that come under NFPA one and other state law and I think it would make sense for us to have that you want to put together a proposal chief on that and I think part of the problem is that the contractor was not aware that there was a sewer line or a water line within a few feet of where he was drilling holes I'm not a blasting expert but a lot of the blasting that I have experienced in the past is done with large mats that really suppress I think that's to keep stuff from going out I think the concern is about the fracturing going down into the ground and hitting the pipes I think if if Nick wants to work with land use and have them review the plans on this retention thing and find out whether or not they're going to be blasting or just fracking as John suggested that would certainly be less problematic is that something you can do we can certainly do that I'm sure the planning board actually made them pay for their town's own construction engineer to monitor the construction it would be easy enough to confirm that with planning since you're communicating now with them a phone call or an email might resolve that I understand the concerns because the water sewer lines are very very much proximal and we don't want to have disruption people who live on the intervail would definitely not want the sewer line and I don't think these guys want to damage it because it would be because it's a pressurized it would be a mess yes it would be you know it would be bad enough if it was just a gravity lock yeah right all right anything else Mr. Williams the only thing I'd like to note is that today is our town clerk's birthday and some of the employees got together today and wish Jane Farrell our happy birthday so happy birthday to Jane from the board and thank you for her service to the community and that's the only thing I have so now we're going to go into
