Swanzey Zoning Board Meeting August 17th, 2026
The Swanzey Zoning Board met August 17, 2026, for a business-only session with all three alternates seated to ensure participation. No decisions or votes were taken as only two full members attended; the board opted to defer items requiring a full quorum. Members discussed potential revisions to the rules of procedure, specifically changing references from "clerk" to "recording secretary" and clarifying meeting location language to specify "location listed on notice" rather than a fixed venue. Members also raised concerns about the long-term enforcement of conditions placed on property approvals, noting reliance on code enforcement officer Chris Levy. A joint meeting on zoning organization was scheduled for Thursday, September 17, 2026, at 6:00 PM. SPEAKER_1, who will be absent, agreed to forward comments regarding the joint meeting to another member. The board adjourned without setting a next business meeting date.
You are watching a Fact TV presentation of the town of Swansea. Heat. Hey, Heat. [music] Heat. Heat. Hey. Hey. Hey. Heat. Heat. Heat. N. >> [music] >> Hey, hey, hey. Hey, hey, hey. Hey. Hey. >> We have a full board. So, I think we'll call the meeting we need to order. I didn't print out the packet, so >> Oh, I Sorry. I couldn't make it down all day. >> I No, that's that's fine. I I I don't think I need it. I I think I I brought some stuff to take notes with. Um >> so I I think we'll call the meeting to order. Should we do the roll call? >> And >> here >> here. Now, uh since this meeting is is business only as I from what I read in the what we have for the doc um >> right we're only talking about >> Yep. So the only things on the agenda today are the rules of procedure discussion. Um before that would be the approval of the July 20th minutes. >> Okay. Has everyone had a chance to read the the minutes? >> Yes. >> Would anyone care to make a motion on the >> Hey, before the voting, could you see alternates? >> Oh, I Okay. Um, so I'm I'm don't really know who all who all counts as you're an alternate. >> So am I. >> It's Al, right? >> Kyle. >> Alle. >> Wait. Kyle. Oh Jesus. >> Sort of. >> We have three alternates. >> We got three alternates. One member. Two members. Can we >> So we should see Can we see all We're going to seat all the alternates because we want everyone to participate in this. >> So we're going to seat all the alternates. >> Sounds good to me. >> Okay. So we'll do that. We'll seat all. >> Yeah, we need to do that. We do need that. >> Sure. I don't think we need to see her >> and for queen >> and Jessica for not necessarily need it but >> okay >> it's fine And um so we don't have to talk about regional impact since we're not having a hearing. >> So so we'll we can set that aside. so >> with three of the full members not here, >> do we want to defer the discussion on the rules and procedure? >> Probably. >> Well, I would I would >> Well, that will get me to mark your basket quickly. say no because I I'm here. >> Exactly. Like we've been >> It seems like the three >> Well, we can't. >> This is the whole reason we're here. >> Yes, you can. You're seated. So, >> yeah, you can >> to come here and then not do it. >> Vote. >> It's not a matter of voting or not voting. It's a matter of >> three full-time members aren't here. >> Yeah. >> Should we at least can we vote on the minutes? could we move something along and then we can decide that we're stalling to see if they come and show up. So >> yeah, >> um if everyone's read would anyone like >> I can make a motion to accept the minutes as presented second >> poor Kyle whatever >> they're all not all our meetings are like this so you know. All right. >> So, >> all in favor? >> Well, in favor is all in favor of the of accepting the minutes as written. >> I I getting some housekeeping done. >> Yeah. And Adam did just email me saying something came up so >> Okay. >> Nothing to do yet. Is it okay to at least discuss the like if we have any corrections that we noticed? We don't necessarily have to vote them in, but >> what do you think? >> I think it should be in front of the full board or more than just two. >> Yeah. I'd repeat what I said. I think it needs the the full board or at least four or five of the full members, >> right? and to discuss it. You're going to repeat that. >> You're going to do it all over again in front of everybody. >> So, to me, it doesn't make sense. >> Well, that was fun. >> Not if we can amend something and have it ready for the next meeting. >> What's that? >> If we can have something amended that that needs >> I'll just say the paragraph about the clerk that's been changed to recording. Just the paragraph language just needs to reflect the title. >> Oh, I see >> of the paragraph. That's all. >> Recording. >> Yes. Recording secretary. It's because it refers to the clerk in the paragraph a couple of times. So, it just needs to be changed to recording secretary. >> That's all I noticed. >> Right. >> Um so, I had one small question had to do with um the posting of where we meet for the meetings. This is on page 10 of 16 where it said um our meetings are held every month on the third Monday of every month at Wickcham law. I I became aware this weekend that there's going to be that the select board is meeting at at the new fire station which I didn't even know it was open yet >> that >> that the select men are going to be meeting. They're having a special meeting at the at the new fire station on Wednesday night. >> Wednesday night. Is there should we have anything in here about I mean because you're publicly um announcing the meetings if there is an emergency and they need to change the venue. Do we just skip that month because you won't have time to notice everyone? >> Um we could just do something like that time and place noted on the public hearing notice. >> Yeah. I'm just I was just wondering if that and that's that's the only comment I had from the reading I did that maybe we should have something there as a as a alternate in case. >> Yeah. Um I like that. Um or Yeah. Or it could just say 700 p.m. at location listed on notice. >> Because that leaves it open to change >> that. Yeah. That way I mean it's just a thought. So >> good point. >> That much closer to ice cream. It is that they might discuss. >> See that? You thought I didn't read it. I did. >> I didn't. >> I was pretty I even used my own laser printer to print that out. which which by the way Sam's is closing and I picked up a couple of laser printers over there for 10 bucks a piece >> laser printers brother and brother laser printers duplexing no less >> how they're an outdoor they were an outdoor store >> they're a store they have a ton of stuff in there they have free free desk free metal desks free metal file cabinets you know those big >> those those four those four tier here. >> Didn't say anything about the yard sale there, did it? >> No. Well, some of it was not free until recently. >> But the file c the metal file cabinets that you have in your office, they're all free. >> Free free shelving. >> They also have barcode scanners. They've got thermal laser printers. Um, really >> label regular label. in there >> that we want to jot down before the next meeting. >> Otherwise, we're not going to meet again until September 21st [clears throat] and then of course I will hopefully see all of you on the 17th for the joint meeting for the zoning of the organization. and I'm sending out a reminder. >> Um, well, I have a I have an inquiry that might be useful information particularly for our new member Kyle whose name I have retained for five minutes. when we have a uh an application that comes before us and we put conditions on that application and uh and let's say the planning it goes to the planning board and they put expectations on that they put conditions on it. How long do those conditions last? >> Depends. Um so right now approvals if it's a site plan they're now approved for three years. Well, more of a meeting is like, well, I'll just use an example. Let's say somebody puts up is required to put up a fence between a business and a residence >> and then that that um business allows that fence to go into disrepair and trees to grow up against it and uh potentially rip it down, thereby exposing the homeowner to the business. If are they required to upkeep that? >> It depends on how the conditions were, but probably. So if a bench was required for the condition of the site plan, >> they would be required to have that up. >> So if if if I knew four people that were at a meeting 10 years ago requiring that and that the notes were not put in, they they the notes were not put in, what happens then? >> Well, we would need some sort of some sort of record on those conditions. >> So this this is where I think it's very important. Um Kyle and everyone else here, if we put conditions on a property, we need to I want to know if if whatever conditions we make are are done that they're that the homeowner follow or property owner, business owner follows through with those conditions the way we had presented them and if and how long that would exist. How long we have to maintain that? >> Yep. They're always noted on the notice of decision and amendments. >> Okay. Because the the impression I get is that those homeowners are not protected long term. >> That would be Yeah. So that that would be a code issue. >> Yeah. It's hard to police it >> and it's it's been the same issue that we talked about. >> It is. >> Isn't that the role of code enforcement? >> Yeah. I have never heard from the code enforcement officer. Who is that? >> Chris. >> Chris. What's his last name? >> Levy. L E Y. Just tagged me in email and I know I responded. >> Oh, I know you did. You've responded to every email I've ever sent you. >> Chris has not. >> I will, but I'll reach out. >> It's okay. >> I'll talk I'm going to talk to him. >> Adam, going back to the joint meeting, I mentioned it at the initial meeting. I will be away. >> I'll have I do have a couple of comments. Should I forward them to you or send them to Sarah? I'll >> forward them to me, please. >> Okay, I'll set I just got a couple of comments that I would have made at the joint meeting. >> Yeah, whatever you got. >> Thank you. >> What time is that meeting? >> It'll be at 6:00 up here. >> Okay. Thank you. >> Unless they're working on the floors, in which case we'll send that a new location. Maybe the fire station will be a good location, but maybe not. We'll see. That's September 17th. >> Do you expect alternate with any football? >> You wrote the first one. >> That would be sick. >> Oh, it's a Thursday night. >> Yep. Since Thursday, 6 o'clock. Be here if you can. That's it. I >> Anyone make want to make a motion? >> Motion to adjourn. >> Second it. >> I. >> All in favor? >> I >> thank you. Thanks.
